The Shanghai Headquarters, all branches and business management departments and all central branches in capital cities and central sub-branches of deputy provincial cities of the People's Bank of China; all local offices of China Banking Regulatory Commission; and all state-owned commercial banks and shareholding commercial banks:
 
中国人民银行上海总部,各分行、营业管理部,各省会(首府)城市中心支行、副省级城市中心支行;各银监局;各国有商业银行、股份制商业银行:

Pursuant to the spirit of the National Urban Housing Work Conference in 2007 and such policy provisions as Opinions of the State Council on Solving the Housing Difficulties of Low-Income Families (No. 24 [2007] of the State Council) and Notice of the General Office of the State Council on Forwarding the Opinions of the Ministry of Construction and Other Departments on Adjusting the Housing Supply Structure and Stabilizing the Housing Prices (No. 37 [2006] of the General Office of the State Council), the relevant matters on strengthening the administration of commercial real estate credit loans are hereby notified to you as follows:
 
根据2007年全国城市住房工作会议精神及《国务院关于解决低收入家庭住房困难的若干意见》(国发〔2007〕24号)、《国务院办公厅转发建设部等部门关于调整住房供应结构稳定住房价格意见的通知》(国办发〔2006〕37号)等政策规定,现就加强商业性房地产信贷管理的有关事项通知如下:

 
I. Strict administration of loans for real estate development   一、严格房地产开发贷款管理

For a project in which the ratio of project capital (ownership interest) is under 35% or the certificate of land use right, planning permit for construction land, planning permit for construction project or construction permit has not been granted, a commercial bank shall not make a loan in any form; for a real estate development enterprise that is found by the authority for land and resources or competent authority for construction to have stocked up land or housing sources, a commercial bank shall not make a loan to it; and for commercial buildings that have been vacant for three years, a commercial bank shall not accept them as collateral for a loan.
 
对项目资本金(所有者权益)比例达不到35%或未取得土地使用权证书、建设用地规划许可证、建设工程规划许可证和施工许可证的项目,商业银行不得发放任何形式的贷款;对经国土资源部门、建设主管部门查实具有囤积土地、囤积房源行为的房地产开发企业,商业银行不得对其发放贷款;对空置3年以上的商品房,商业银行不得接受其作为贷款的抵押物。

A loan of a commercial bank to a real estate development enterprise may be made only through the loan subject of real estate development, and it shall be prohibited to make a loan through any other loan subject such as real estate development working capital.
 
商业银行对房地产开发企业发放的贷款只能通过房地产开发贷款科目发放,严禁以房地产开发流动资金贷款或其他贷款科目发放。

In principle, a loan for real estate development made by a commercial bank may only be used for a local real estate development project, and shall not be used in a cross-region way. For a loan, the use of which is really needed in a non-local real estate development project and for which the relevant risk control measures have been implemented, a commercial bank shall report on it to the regulatory authority for archival purposes before the loan is made.
 
商业银行发放的房地产开发贷款原则上只能用于本地区的房地产开发项目,不得跨地区使用。对确需用于异地房地产开发项目并已落实相应风险控制措施的贷款,商业银行在贷款发放前应向监管部门报备。

 
II. Strict and standard administration of land reserve loans   二、严格规范土地储备贷款管理

A commercial bank shall not make a loan especially for the payment of land assignment fees to a real estate development enterprise. A loan to a government land reserve institution shall be made in a manner of mortgage loan, the loan credit shall not exceed 70% of the appraisal value of the acquired land, and the loan term shall not exceed two years at most.

商业银行不得向房地产开发企业发放专门用于缴交土地出让金的贷款。对政府土地储备机构的贷款应以抵押贷款方式发放,且贷款额度不得超过所收购土地评估价值的70%,贷款期限最长不得超过2年。
