The accused, Zhang Binchang, male, 59 years old, was General Manager of Lanzhou Steel & Iron Group Company in Gansu Province (Chief position at the departmental level in a provincial government).@#
The Peoples' Procuratorate of Lanzhou City in Gansu Province placed the case, which concerned Zhang Binchang's being suspected of crime of embezzlement, crime of accepting bribe and crime of misappropriating public funds, on file for investigation and prosecution on May 8, 1997. The Peoples' Procuratorate instituted public prosecution to the Intermediate People's Court of Lanzhou City on June 15, 1998. In the bill of prosecution, the Peoples' Procuratorate found Zhang's criminal facts as follows:@#

被告人 张斌昌,男,59岁,捕前系甘肃省兰州钢铁集团公司总经理(正厅级)。@#
1997年5月8日甘肃省兰州市人民检察院对张斌昌贪污、受贿、挪用公款案立案侦查。1998年6月15日向兰州市中级人民法院提起公诉。起诉书认定张斌昌的犯罪事实如下:@#
1994年7、8月份,被告人张斌昌任酒泉钢铁集团公司常务副总经理期间,将上海宏光实业总公司嘉峪关分公司经理吕锡赞托其归还欠酒泉钢铁集团公司货款的一张10万美元存单贪污,将存单交给其子张丰宇,并告诉张丰宇存折到期后取出利息再以各2万元数额转存。@#
1991年至1995年,被告人张斌昌任酒泉钢铁集团公司常务副总经理、兰州钢铁集团公司总经理期间,利用职务便利,为他人谋取利益,多次收受吕锡赞、缪南浩等人所送人民币44万元、国库券10万元、港币9万元及美元3.1万元。@#
1996年1月,被告人张斌昌指示兰州钢铁集团公司副总经理王森给甘肃省飞天金属材料中心供给36万元钢材,以此钢材折抵兰州钢铁集团公司欠酒泉钢铁集团公司的货款,后甘肃省飞天金属材料中心将141.31吨钢材提走,兰州钢铁集团公司财务处从兰州钢铁集团公司欠酒泉钢铁集团公司的货款中下账人民币36万元。同年底,被告人张斌昌打电话给甘肃省飞天金属材料中心经理潘碧珍,以购房为名索要36万元货款。12月5日潘派人将两张18万元的支票交给张斌昌,张斌昌于12月6日到招商银行兰州市分行填写进账单开户进账,办“一卡通”一张,将36万元公款挪用于购买私房。@#
