On April 3, 2008, the People's Court of Jian'ou City, Fujian Province rendered a judgment for supply contract disputes between the plaintiff, Jian'ou Liwei Plastics Co. Ltd. (hereinafter referred to as “Liwei Company”), and the defendants, Shenzhen Dejan Plastics & Bakelite Co. Ltd. (hereinafter referred to as “Dejan Company”), Chen Shaohuan and Hong Guicheng, ordering Dejan Company to make payment for goods of 509,250 yuan plus liquidated damages to Liwei Company and ordering Chen Shaohuan and Hong Guicheng to be jointly and severally liable for the above arrears as guarantors. | |
2008年4月3日，福建省建瓯市人民法院对原告建瓯市立伟塑料有限公司与被告深圳市德扬塑胶电木有限公司、陈少欢、洪桂成买卖合同纠纷一案依法作出判决，判令深圳市德扬塑胶电木有限公司向建瓯市立伟塑料有限公司支付货款人民币509250元及违约金，陈少欢、洪桂成个人对上述欠款承担保证责任。 |
After this judgment came into force, Chen Shaohuan and Hong Guicheng (husband and wife) sold their real estate located at 18 New Area Lane 3, Tangxiayong Community, Songgang Sub-district, Bao'an District, Shenzhen City for 2.2 million yuan on May 8, 2008, and sold the machinery of Dejan Company for 115,000 yuan in July 2008. They did not use the proceeds from the sales to perform their obligations determined in the effective judgment. Instead, they transferred such proceeds to other places, causing impossibility to enforce the court judgment.
