| | 本院受理原告邹昌绿诉被告上海宝尊电子商务有限公司（以下简称宝尊公司）、浙江天猫网络有限公司网络购物合同纠纷一案后，被告宝尊公司在提交答辩状期间对管辖权提出异议，认为本案所涉买卖合同的主体系邹昌绿与宝尊公司，宝尊公司住所地在上海市闸北区，根据民诉法第二十一条关于“对法人或者其他组织提起的民事诉讼，由被告住所地人民法院管辖”之规定，本案应由上海市闸北区人民法院管辖，因此，请求将本案移送至上海市闸北区人民法院审理。本院于2015年7月16日召集双方进行管辖听证，并于7月16日作出(2015)杭余商初字第791号民事裁定，裁定：驳回原告邹昌绿对被告浙江天猫网络有限公司的起诉。现该裁定已经发生法律效力。 |
| | 经审查，本院认为，本案中，邹昌绿主张与宝尊公司之间系网络购物合同纠纷，根据《民事诉讼法》第二十三条之规定，“因合同纠纷提起的诉讼，由被告住所地或合同管辖地人民法院管辖”，而根据《最高人民法院关于适用<中华人民共和国民事诉讼法>的解释》第二十条之规定，“以信息网络方式订立的买卖合同，通过信息网络交付标的物的，以买受人住所地为合同履行地；通过其他方式交付标的物的，收货地为合同履行地”，本案中邹昌绿主张的系宝尊公司未按约发货所应承担的责任，由此可见，本案所涉标的物尚未交付，合同履行地尚无法确定，因此，本案应当按照被告住所地即宝尊公司的住所地确定管辖，而宝尊公司的住所地位于上海市闸北区，故本案应由上海市闸北区人民法院管辖。综上，宝尊公司提出的管辖异议，理由成立，本院予以支持。据此，依照《中华人民共和国民事诉讼法》第二十三条、第一百五十四条第一款第（二）项，《最高人民法院关于适用<中华人民共和国民事诉讼法>的解释》第二十条之规定，裁定如下： |
