Plaintiff, La Filipina UY Gongco Corporation (hereinafter referred to as Gongco Corp.) filed a suit at the Maritime Court of Guangzhou because of the disputes of fraudulent shipping and infringement of rights between itself and the defendants Dexing Shipping Co. Ltd (hereinafter referred to as Dexing Co.) and Qinglong Shipping Industrial Corporation (hereinafter referred to as Qinglong Corp.) and Guangzhou Branch of Qinglong Corp. (hereinafter referred to as Guangzhou Branch).@#
Plaintiff Gongco Corp. claimed that:
Defendant Dexing Co. sold to others a batch of goods that the plaintiff had loaded on the ship “Golden Sunlight” by forging bills of lading in the name of the registered ship-owner. Defendant Qinglong Corp. is the real owner of the ship “Golden Sunlight”, of which Guangzhou Branch is the real operator. Qinglong Corp. had verified the forged bills of lading issued by Dexing Co., on which Guangzhou Branch had sealed and confirmed its effectiveness with an indication. The activities of the two defendants, together with Dexing Co.'s, have constituted a joint infringement of rights. Thus the plaintiff requests the court to order the three defendants to return the goods it had purchased with its total value of $1.69 million, and compensate it for the whole economic losses incurred therefrom.@#

原告菲律宾国拉菲贡公司（以下简称拉菲贡公司）因与被告巴拿马德兴船务有限公司（以下简称德兴公司）、被告海南青龙船务实业总公司（以下简称青龙总公司）、被告海南青龙船务实业总公司广州分公司（以下简称“青龙分公司”）发生海运欺诈侵权纠纷，向广州海事法院提起诉讼。@#
原告拉菲贡公司诉称：被告德兴公司以注册船东的身份伪造提单，将原告装在“金色阳光”轮上的一批货物销售给他人。被告青龙总公司是“金色阳光”轮的实际所有人，被告青龙分公司是“金色阳光”轮的实际经营人。青龙总公司对德兴公司签发的假提单进行核实，青龙分公司在该假提单上盖章批注确认其效力，二被告的行为已构成与德兴公司共同侵权。请求判令三被告返还原告购买的总价值为１６９万美元的货物，并赔偿因此给原告造成的全部经济损失。@#
被告青龙总公司辩称：与“金色阳光”轮本航次的承租人希借雅典ＲＡＤＩＡＮＴ船务公司签订航次租船合同的是“金色阳光”轮的船东、本案被告德兴公司。本公司既不是“金色阳光”轮的实际所有人，也与该轮没有任何关系。原告向法庭提供的抬头有本公司标记的传真件，是青龙分公司使用本公司的便笺纸发出的，并非本公司发出，不应该对本公司产生约束力。原告认为本案所涉运费是由本公司代收，本公司对德兴公司出具的第二份提单进行了核实，均与事实不符。原告一直无法证明本公司在主观上有欺诈的过错，客观上实施了欺诈的行为，故不应让本公司承担任何责任。原告起诉本公司，既没有法律依据也没有事实根据，应当驳回。@#
被告青龙分公司辩称：本公司与被告德兴公司之间存在着船务代理关系，不是船舶租用关系。本公司是经德兴公司授权，为其代催、代收运费以及代核实提单。本公司代德兴公司核实提单时，不知道该提单是假冒的，不存在欺诈原告的恶意，与原告被欺诈一事无任何联系。本公司只是作为德兴公司的代理人履行了自己的职责，既在主观上没有欺诈原告的故意，也在客观上没有实施欺诈原告的行为。法院应当驳回原告对本公司的诉讼请求。@#
被告德兴公司未作答辩。@#
广州海事法院经审理查明：@#
１９９７年７月１８日，原告拉菲贡公司向中化（英国）有限公司购买了１２００２吨尿素，价格为每吨１４１美元。保加利亚索菲亚ＣＨＩＮＥＸＰＩＲＴ公司作为托运人，将该批货物在乌克兰敖德萨港装上“金色阳光”轮，并向该航次租船人ＲＡＤＩＡＮＴ公司支付了从乌克兰敖德萨港至菲律宾ＩＬＯ　ＩＬＯ港的运费。８月１８日，中远敖德萨船务商贸有限公司作为“金色阳光”轮的船务代理，签发了一套号码为４４０７０１００２１７９９的货物已装船正本清洁提单。提单记载：发货人为俄罗斯诺佛莫斯科佛斯克（ＡＺＯＴ）公司，收货人为“按照菲律宾群岛银行指示”；船舶为“金色阳光”轮；装货港为乌克兰敖德萨港，卸货港为菲律宾ＩＬＯ　ＩＬＯ港；船东为被告德兴公司；货物名称及数量为尿素１２００２吨；运费为“按租船合同支付”。卖方中化（英国）公司当天收到了该提单。@#
被告德兴公司曾于１９９７年６月３０日给被告青龙分公司出具委托书。该委托书记载：兹委托青龙分公司作为我司的代理人，代理我司处理“金色阳光”轮在欧洲与东南亚或中国航线的委托装港、卸港代理，添加淡水、燃料和物料，代催、代收运费以及其他必要的代理事宜。１９９７年８月２０日、１０月１４日，青龙分公司的雇员邢德彰和焦长仁分别用以被告青龙总公司抬头的便笺纸给“金色阳光”轮航次租船人ＲＡＤＩＡＮＴ公司发传真，追讨本案所涉航次的运费，发传真的电话号码是青龙分公司的号码。@#
