He was sentenced to a fixed term of imprisonment for five years because of crime of robbery in 1989, was released after the completion of sentence on December 20, 1993 and was arrested on August 29, 1996.@#

The Intermediate People's Court of Chongqing Municipality of Sichuan Province charged defendant Wang Zhouyun with the crime of kidnapping and extortion, sentenced him life imprisonment, deprived him of political rights for life, fined him 10, 000 yuan and confiscated his tools for criminal purpose, namely 1 mobile phone (Motorola 8900). It charged defendant Chen Jinming with the crime of kidnapping and extortion, sentenced him life imprisonment, deprived him of political rights for life, fined him 10, 000 yuan and ordered him to refund Wei Wenchun, the victim, 20, 000 yuan. It charged defendant Zhang Wenqi with the crime of kidnapping and extortion, sentenced him a fixed term of imprisonment for 13 years, deprived him of political rights for 3 years, fined him 2, 000 yuan and ordered him to refund Wei Wenchun 4, 000 yuan. It charged defendant Liu Changhua with the crime of kidnapping and extortion, sentenced him a fixed term of imprisonment for 13 years, deprived him of political rights for 3 years, fined him 2, 000 yuan and ordered him to refund Wei Wenchun 2, 000 yuan. After the judgment was announced, Wang Zhouyun and Chen Jinming refused to accept it, Wang Zhouyun, on the grounds that “his purpose was to demand the compensation he should have obtained rather than extort property, the conviction in the original judgment is incorrect and the sentencing is inappropriate and he should be given a lenient punishment”, and Chen Jinming, on the grounds that “at the request of Wang Zhouyun, he called Liu Changhua and Zhang Wenqi to collect payments, he didn't participate in the specific act, so he committed no crime of kidnapping and robbery”, appealed to the Higher People's Court of Sichuan Province.@#

四川省重庆市中级人民法院以被告人王周云犯绑架勒索罪，判处其无期徒刑，剥夺政治权利终身，并处罚金人民币１万元，作案工具摩托罗拉８９００型移动电话一部予以没收；以被告人陈金明犯绑架勒索罪，判处其无期徒刑，剥夺政治权利终身，并处罚金人民币１万元，责令退赔被害人魏文春人民币２万元；以被告人张文棋犯绑架勒索罪，判处其有期徒刑十三年，剥夺政治权利三年，并处罚金人民币２０００元，责令退赔被害人魏文春人民币４０００元；以被告人刘长华犯绑架勒索罪，判处其有期徒刑十三年，剥夺政治权利三年，并处罚金人民币２０００元，责令退赔被害人魏文春人民币２０００元。宣判后，被告人王周云、陈金明不服，王周云以“主观动机是追索应得的补偿费，不具有勒索财物的目的，原判定性不准，量刑不当，要求从轻处罚”为由，陈金明以“是受王周云之托，打电话叫刘长华、张文棋帮王周云收帐，具体行动我没参与，因此不构成绑架勒索罪”为由，分别向四川省高级人民法院提起上诉。@#
四川省高级人民法院经审理查明：１９９６年初，上诉人王周云与被害人魏文春商量共同租赁渝中区金鹰商场二楼的摊位。后王周云因病住院治疗，魏文春即独自与金鹰商场签订了租赁合同，并缴纳了定金和前期租赁费。３月底，王周云病愈出院，对魏文春单方租赁商场不满，坚持要投资入股。魏碍于情面，于４月３日与王周云正式签订了合股经营协议，约定王周云应投资１２０万元。其后，王周云因无资金投入，便私自将协议中自己承担的投资部分转让给上诉人陈金明和案外人王某、吴某等３人投资。魏文春得知后坚决反对，经他人调解，协商由魏文春补偿给陈、王、吴３人各１０万元并另给王周云补偿５万元后，王周云等４人都退出合股经营。后来，魏在电话上口头同意给王周云补偿３万元，又因得知王将从陈金明、王某、吴某等人处得“好处费”时，不再同意给王补偿。５月初，王周云向陈金明提出，魏文春没有给他补偿费，要求陈找人向魏索要５万元的补偿费，陈表示同意。５月１２日，陈金明让原审被告人刘长华找两个人去帮王周云收帐，并让原审被告人张文棋也一起去，具体行动听王周云安排。１４日上午，刘长华携带一把仿日军刀，约周渝、郑渝（均另案处理）一起到陈金明办公室与张文棋、王周云会合。王周云对刘、张等人称魏文春欠他５万元，叫刘、张等人帮他收帐，并让刘、张等人先在陈金明办公室内等候，自己外出找魏。当日下午２时许，王周云发现魏文春在重庆三元百货公司休闲屋内，即传呼通知刘、张等人。刘长华、张文棋、郑渝、周渝４人携带一把刀和一支土制手枪赶至，由张文棋以有事找魏为借口将其骗出，４人即叫魏偿还王周云５万元钱，魏否认。刘长华、周渝持刀、枪威逼魏文春，强迫与其同行，推拉中魏的右手指被刘的刀划伤出血。４人强迫魏到街上后，分乘两辆出租车，将魏挟持到九龙坡区上桥张家湾东风机械厂家属区刘的女友家。刘长华、张文棋强行要魏在当日内拿出５万元现金才放行，，魏被逼迫用张提供的移动电话与好友戚某等人联系借款，但只借到３万元。刘、张电话与王周云、陈金明联系，王、陈同意先拿上３万元。刘、张要求魏再写３万元的欠条，同时要魏取下随身佩戴的钻戒、金项链和玉佩作抵押。当晚７时许，魏文春的司机官某带上借来的３万元现金，同王周云等人到九龙坡区上桥汽车站与张文棋、刘长华会面交涉赎人。官因未见魏不愿先给钱，由王周云出面协调担保后，官将３万元现金交给王，刘长华、张文棋才通知郑、周将魏文春放行。当晚９时许，王周云与陈金明联系后，赶去渝中区金龙大酒店将３万元交给陈金明，陈分给刘、张等人１万元作“辛苦费”。次日，王周云、陈金明将金首饰及欠条等退还魏文春，并向其赔礼道歉。事隔数日后，魏文春怕以后再有麻烦，遂报案。@#
