In December 1986, without authorization, Li Hong began to build a private house on the nursery of 0.19 mu contracted by him with the Production Team. After the construction commenced, some villagers and officials of the village tried to dissuade Li Hong from construction, but he turned a dead ear to them. The Government of the Township ordered Li Hong to demolish the illegal building within three days, but he said rudely that: “I will continue building the house, and I dare you to capture me within three days.” The leader of Tuanjie Office reasoned with Li Hong, but with a bad attitude, Li Hong refused to listen to any dissuasion, and forcedly completed the foundation works of 72.39 sq.m. Tuanjie Office reported it to the Bureau of Environmental Protection for Urban and Rural Construction of Xishan District for handling. The leader of this Bureau came to Dahe Village in person, told Li Hong aboutthe Land Administration Law, and tried to persuade him to voluntarily demolish the illegal building. Not only did Li Hong refuse to listen, but also rudely said that: “even if you send me to labor camp for reform, I will build the house.”@#

1986年12月,李洪擅自在他向生产队承包的1分9厘秧田上建私房。动工后,群众和村干部劝告制止,李洪不予理睬。乡政府责令李洪在3天内拆除违法建筑,李洪蛮横地说:“房子我要继续盖,限你们3天把我抓起来!”办事处的领导人对李洪进行教育,李洪态度恶劣,不听劝阻,强行完成72.39平方米的地基工程。办事处报请区城乡建设环境保护局处理。该局领导亲自到大河村,向李洪进行土地管理法的宣传教育,劝其自动拆除违法建筑。李洪不仅不听,竟无理地说:“你们抓我去劳改,我也要盖!”@#
西山区城乡建设环境保护局根据《中华人民共和国土地管理法》第四十五第关于“农村居民未经批准或者采取欺骗手段骗取批准,非法占用土地建住宅的,限期拆除或者没收在非法占用的土地上新建的房屋”的规定,于1987年1月10日作出决定:“李洪未经批准,擅自在承包的秧田上建盖房屋是非法的,必须立即停工,自接到处理决定之日起3日内拆除违法建筑,恢复耕地。”同时,根据土地管理法五十二条的规定,告知当事人“对行政处罚决定不服的,可以在接到处罚决定通知之日起30日内,向人民法院起诉;期满不起诉又不履行的,由作出处罚决定的机关申请人民法院强制执行。”@#
