韩寒与北京百度网讯科技有限公司侵害著作权纠纷案（北京市海淀区人民法院[2012]海民初字第5558号民事判决书） @#
【案情摘要】韩寒为当代知名青年作家，其在百度文库中发现有多位网友将其代表作《像少年啦飞驰》（以下简称《像》书）上传至百度文库，供用户免费在线浏览和下载，其多次致函经营百度文库的北京百度网讯科技有限公司（简称百度公司）协商处理未果。韩寒认为百度公司侵犯了其《像》书的信息网络传播权，向北京市海淀区人民法院提起诉讼，请求立即停止侵权、采取有效措施制止侵权，关闭百度文库，赔礼道歉，赔偿经济损失25.4万元并承担律师费、公证费等。百度公司强调百度文库属于信息存储空间，其中的文档由网友贡献，百度公司收到韩寒投诉后，及时删除了投诉链接和相关作品，并将投诉作品纳入文库反盗版系统正版资源库，采用技术措施预防侵权，不存在过错，不应承担侵权责任。北京市海淀区人民法院审理后认为，百度公司经营百度文库，一般不负有对网络用户上传的作品进行事先审查、监控的义务，但并不意味着百度公司对百度文库中的侵权行为可以不加任何干预和限制。考虑到涉案作品为知名作家的知名作品，韩寒曾于2011年3月作为作家代表之一就百度文库侵权一事与百度公司协商谈判，百度公司理应知道韩寒不同意百度文库传播其作品，也应知道百度文库中存在侵犯韩寒著作权的文档，百度公司对韩寒作品负有较高的注意义务。对于负有较高注意义务的《像》书侵权文档，百度公司消极等待权利人提供正版作品或通知，未能确保其反盗版系统正常运行之功能，也未能采取其他必要措施制止该侵权文档在百度文库传播，主观上存在过错，故判决百度公司赔偿韩寒经济损失39 800元及合理开支4000元。该判决一审生效。@#
