| | 方淑英因与被告方子安等继承纠纷一案，于 2007年7月12日向福建省福州市台江区人民法院(以下简称台江区法院)提出财产保全的申请，请求冻结属方德铨的房屋拆迁补偿款人民币300000元。同日，台江区法院通知方淑英应提供担保，并裁定立即冻结拆迁补偿款300000元。7月13日，台江区法院案件承办人到福州市拆迁工程处要求冻结房屋拆迁补偿款，但被该处工作人员口头告知该拆迁款在开发商处，应向开发商冻结。因方淑英提供的开发商名称有误，7月13日当日，承办人经多方查找联系开发商未果。经核查开发商准确名称为福建永德信房地产开发有限公司(以下简称永德信公司)，台江区法院于7月17日向永德信公司和福州市拆迁工程处重新作出协助执行通知书，并于当日向福州市拆迁工程处送达，因仍查询不到永德信公司的住所地，该院承办人将协助通知书和裁定书送达到拆迁工地，由工作人员转交。7月18日永德信公司在送达回证盖章，并说明拆迁补偿款已于 7月14日由方子安领取。7月24日，经办人将拆迁款已于7月14日被方子安领走的事实告知方淑英代理人。嗣后，台江区法院于2012年1月5日作出裁定，认定“方子安暂无财产可供执行”，2012年3月20日，台江区法院以经查证被告方子安已死亡为由，裁定终结该案执行。 |
