 民法通则》第83条对相邻关系的规定较原则,对相邻关系的客体列举较少,只列举了截水、排水、通行、通风、采光等相邻权利,没有本案中噪声、排烟等方面的规定。但相邻各方在行使权利时,没有为邻人提供方便,产生的噪声和排放的油烟污染了相邻方,可以认定侵害了相邻权。

 【案情】
 原告陈洪森等27人,均住蚌埠市交通家园。
 被告邸哲明,恒丰大酒店经营者,住蚌埠市交通路220号。
 陈洪森等27位原告与被告邸哲明开设酒店的房屋同在蚌埠市交通路“交通花园”小区。27位原告系该区三栋坐北朝南住宅楼(均为六层)的部分住户,被告在该区开办了恒丰大酒店,从事餐饮业(未办理工商登记)。该酒店所处的裙楼为二层楼房,坐东朝西,位于2号住宅楼和1号、3号住宅楼(1号楼在东、3号楼在西,两楼相连)之间,与住宅楼垂直连成一体。被告开设的酒店的灶间(在二楼)上方为原告宋在文的住房,灶间引风机的声音对周围的住户形成噪声污染。被告又将酒店二楼东边的墙打通,开一门通向位于灶间北侧的平台(原为四周封闭)。灶间的烟囱向北平行穿越该平台后顺3号住宅楼楼梯间的墙壁往上延伸,达住宅楼第4层的高度。该平台下面系一楼的一间房屋,与被告饭店一楼相连,但不归被告所有。被告在此间房屋临交通花园小区的东墙上开出一门,装上防盗门,现已用角钢将门焊上。被告饭店的工作人员在平台上洗菜、洗碗,以致污水流至小区内。27位原告以被告开设的饭店产生的噪声、排烟等侵害相邻权为由,诉至法院。
 原告陈洪森等诉称,2004年1月28日,被告未经工商部门批准,擅自在原告居住的“交通花园”小区内开设饭店,并非法将公用房屋打开一个门通向小区,又利用二楼公用平台洗菜、洗刷餐具,污水流到小区内,造成污染。被告经营时,灶间引风机的噪音和所排放的烟雾都很大,被告的上述行为影响了小区的安全,造成了环境污染。故请求被告立即封上通向小区的门、退出公用平台、消除引风机震动的噪音,治理污染、合理排烟,停止侵害,排除妨碍。
