| | 2011年11月10日,张正其经人介绍到原告成都市市政工程(集团)有限责任公司(下称市政公司)承建的重庆市荣昌县广顺街道污水处理工程工地上从事守工地材料和指挥过往车辆通行工作。2011年11月24日下午,负责组织、安排工人挖孔桩的杨中金给了第三人10元钱,让其骑摩托车去买饮用水。张正其买水后返回工地的路上摔倒受伤,被送往重庆永荣矿业有限公司总医院治疗,经诊断为:1.右肩锁关节脱位;2.右桡骨小头骨折。2012年9月19日,第三人向被告重庆市荣昌县人力资源和社会保障局提出工伤认定申请,该局于2012年10月9日向原告发出《工伤认定举证通知书》,对第三人受伤的事实进行了调查取证,并于同年11月8日作出《认定工伤决定书》(荣人社伤险认决字【2012】1830号),认定第三人2011年11月24日右肩部、右小臂受伤属于因工负伤,并送达了原告及第三人。市政公司认为重庆市荣昌县人力资源和社会保障局做出的《认定工伤决定书》认定事实错误,程序违法,将其诉至重庆市荣昌县人民法院,要求撤销该认定。 |

| | 重庆市荣昌县人民法院经审理认为,第一,根据《工伤保险条例》第五条第二款之规定,被告重庆市荣昌县人力资源和社会保障局作为县级劳动保障行政部门,依法具有对本辖区内的企业职工受伤是否构成工伤进行认定的法定职责。第二,事实依据方面:1.(2012)荣法民初字第01002号民事判决书以及(2012)渝五中法民终字第2914号民事判决书确认了第三人张正其与原告成都市市政工程(集团)有限责任公司存在劳动关系;2.根据被告所作的调查笔录及原告提供的张正其受伤过程事实的说明,足以证明第三人系骑摩托车外出为工地工人买水时摔倒受伤。第三,第三人于2012年9月19日向被告提交了工伤认定申请及相关的证据材料,被告于2012年9月26日受理,其后向原告发出《工伤认定举证通知书》,并对第三人受伤的事实进行了调查取证,于2012年11月8日作出《认定工伤决定书》(荣人社伤险认决字【2012】1830号),并向双方进行了送达,并不违反法律规定的程序。综上,被告作出的《认定工伤决定书》事实清楚,证据确凿,适用法律、法规准确,程序合法。 |
