Shilin Sub-branch of China Construction Bank (hereinafter referred to as Shilin CCB) lodged a lawsuit with the People's Court of Shilin Yi Autonomous County, Yunnan province against Yang Fubin (hereinafter referred to as Yang) for the dispute over unjust enrichment.@#
Shilin CCB complained that: in the afternoon of February 16, 2002, Yang and his wife brought a deposit book and a savings card to the Garden Street Savings Office of Shilin CCB and required to draw 21,000 yuan. The staff member of the savings office made registration of the drawal of 1,000 yuan on the savings card and of the drawal of 20,000 yuan from the deposit book, but when he actually paid the money, he gave Yang 31,000 yuan by mistake instead of 21,000, so Yang obtained the extra 10,000 yuan. The staff member paid 4 bundles of cash to Yang, of which, there were 2 bundles of 50 yuan, 100 sheets for each bundle; and 2 bundles of 100 yuan, 100 sheets for each bundle. Afterwards, the staff member found that Yang had obtained the extra 10,000 yuan of cash by consulting about the accounts and the video record at the time of his drawing money, and then negotiated with Yang and reported the case to the public security organ, but Yang always refused to return the extra money. We hereby plead the court to order Yang to return the extra 10,000 yuan and assume the litigation fees for this case.@#

原告中国建设银行石林县支行(以下简称石林建行)因与被告杨富斌发生不当得利纠纷，向云南省石林彝族自治县人民法院提起诉讼。@#
原告诉称：2002年2月16日上午，被告及妻子到我行的花园街储蓄所，持存折和储蓄卡要求取款2．1万元。储蓄所工作人员在其储蓄卡上登记取款1000元，在其存折上登记取款2万元，但实际付款时，误将3．1万元作为2．1万元付给被告，致使被告多领1万元现金。当时工作人员支付给被告的现金为4把，其中：50元面额的纸币两把，每把100张；100元面额的纸币两把，每把100张。事后，工作人员经查账并查看当时的录像，发现被告多领1万元现金，遂与其协商并向公安机关报案，但被告始终拒不退还。请求判令被告退还多领的1万元现金，并承担本案诉讼费用。@#

被告辩称：我并未从储蓄所多领1万元。我取款时，储蓄所工作人员再三要求我当面清点，我当场点清领取的是2．1万元后才离开。我领取的现金是，100元面额的纸币10张；50元面额的纸币两把，每把100张；100元面额的纸币两把，每把50张，总共取款2．1万元。原告查账时发现短款就认为是我不当得利，没有任何依据。@#
庭审质证中，被告杨富斌对原告石林建行提供的录像带及取款凭证的真实性无异议，但认为录像带不能反映其多领取了1万元现金，并认为公安机关采用欺骗手段将其传唤讯问，有关笔录不能说明原告的主张。@#
石林彝族自治县人民法院认为，公安机关的受理刑事案件登记表、情况说明、询问笔录、初查报告。不能证明本案双方当事人争议的事实是否存在，故不予确认。对原告石林建行提交的花园街储蓄所2002年2月16日的账目记录、杨富斌的取款凭证以及取款经过的录像带，其真实性予以确认，@#
石林彝族自治县人民法院确认本案的法律事实如下：@#
2002年2月16日上午10点多钟，被告杨富斌持账号为3860250100100063725的存折和账号为860040100100251275的龙卡到原告石林建行所属的花园街储蓄所，要求取款2．1万元。工作人员办理了取款手续后，将面额为100元的10张零散纸币，及面额分别为50元、100元的四把封好的纸币兑付给杨富斌。其中，面额为50元的纸币两把，每把100张，计1万元；面额为100元的纸币两把，石林建行认为每把有100张，计2万元；杨富斌认为每把有50张，计1万元。之后，储蓄所在当日对账时，发现短款1万元，经查看当日监控录像，认为是杨富斌多领了1万元现金。同年3月8日，石林建行向公安机关报了案，处理未果后提起诉讼。@#
双方当事人的争议焦点是：被告杨富斌在取款时，是否多领了1万元现金。@#
