| | 2011年8月，浙江省舟山市普陀区人民法院对郭修朴与王开峰民间借贷纠纷一案作出民事判决，判令王开峰归还郭修朴借款500万元及相应利息。判决生效后，王开峰仅归还50万元。郭修朴遂向舟山市普陀区人民法院申请强制执行。执行立案后，执行法院查封了王开峰与案外人黄竹君共有的房产一套。2013年4月，王开峰与申请执行人郭修朴协商，王开峰与黄竹君承诺以该房产作为抵押向银行贷款200万元用于支付执行款。经郭修朴同意后，执行法院将该房产予以解封。但在申请抵押贷款过程中，王开峰因信用记录不良未能成功办理。2013年7月，在未获得法院及申请执行人同意的情况下，王开峰擅自将该房产以350万卖给他人，所得款项被用于归还个人其他债务及开支。因王开峰名下无其他财产，致使生效判决无法执行。 |
