BASIC FACTS 
Plaintiff: Yichang Radio Factory of Hubei Province 原告:湖北省宜昌市无线电厂。
Legal Representative: Shang Yiguang, factory director 法定代表人:尚宜光,该厂厂长。
Defendant: Luling, female, 28 years old, from Yichang City of Hubei Province, employee of Yichang Radio Factory 被告:卢玲,女,28岁,湖北省宜昌市人,宜昌市无线电厂工人。
Defendant: Niliang, male, 26 years old, from Yichang City of Hubei Province, employee of Yichang Radio Factory 被告:倪亮,男,26岁,湖北省宜昌市人,宜昌市无线电厂工人。
Defendant: Liushan, female, 27 years old, from Yichang City of Hubei Province, employee of Yichang Radio Factory 被告:刘珊,女,27岁,湖北省宜昌市人,宜昌市无线电厂工人。
Defendant: He Guoxiang, female, 29 years old, from Yichang City of Hubei Province, employee of Yichang Radio Factory 被告:何国香,女,29岁,湖北省宜昌市人,宜昌市无线电厂工人。
The Plaintiff, Yichang Radio Factory of Hubei Province (the "Radio Factory"), refusing to comply with the decision of the Yichang Labor Dispute Arbitration Commission over its labor contract dispute with the four defendants Luling, Niliang, Liushan and He Guoxiang, filed a lawsuit in Xiling District People's Court of Yichang City of Hubei Province. 原告湖北省宜昌市无线电厂(以下简称无线电厂)因与被告卢玲、倪亮、刘珊、何国香等4人发生终止劳动合同纠纷,不服宜昌市劳动争议仲裁委员会的裁决,向湖北省宜昌市西陵区人民法院提起诉讼。
The plaintiff stated that it had notified the four defendants to terminate the labor contracts with them due to the expiration of the contracts. However, the Yichang Labor Dispute Arbitration Commission decided that the Radio Factory signed with the four defendants supplemental contracts with a time limit of 2 to 7 years. The plaintiff contends that decision lacks basis in law, and requested the court to terminate its labor contract relations with the four defendants. 原告无线电厂诉称:因4名被告与本厂的劳动合同期满,本厂通知终止劳动合同,宜昌市劳动争议仲裁委员会却裁决本厂与4名被告补签2-7年的劳动合同。这个裁决于法无据,请求人民法院判决终止4名被告与本厂的劳动合同关系。
The defendants contended that the plaintiff should have signed with them the labor contracts with time limit of 5 to 10 years according to "The Detailed Rules for the Labor Contract System for All Employees," which was formulated by the plaintiff. However, the plaintiff neither publicized nor informed the defendants of the contents of rule. Under such circumstances, the defendants were made to sign labor contracts with a time limit of 2 years. The contracts should be void because they are untrue declarations of will. The defendants claim that the award of the Yichang Labor Dispute Arbitration Commission to renew the contracts is correct and should be carried out by the plaintiff. The defendants requested the court to dismiss the plaintiff's suit. 4名被告辩称:按照原告制订的《全员劳动合同制实施细则》,原告应当与我们签订5-10年的劳动合同,但是原告不向我们宣传、告知细则的具体内容,使我们在不知情的情况下与其签订了为期二年的劳动合同。这个劳动合同违背了我们的真实意思表示,是无效的。劳动争议仲裁委员会裁决叫原告与我们续签劳动合同,是正确的,原告应当执行。请求驳回原告的诉讼请求。
After investigation and hearing, the Xiling District People's Court of Yichang City found that the plaintiff had signed 5-year term contracts with the defendants Luling, Niliang, and Liushan during the period from November 1988 to December 1989. The defendant, He Guoxiang, had signed a 5-year term contract with Yichang Xuguang Cotton Mill in 1987, and had been transferred to Radio Factory in 1992. 宜昌市西陵区人民法院经审理查明:1988年11月至1989年12月期间,原告无线电厂分别与被告卢玲、倪亮、刘珊签订了为期五年的劳动合同。被告何国香在1987年与宜昌市旭光棉纺织厂签订了为期五年的劳动合同,1992年调入无线电厂工作。
In May 1995, according to the requirement of the labor contract system, the plaintiff formulated "The Detailed Rules for the Labor Contract System for All Employees of the Yichang Radio Factory," and passed it after due discussion in the Workers' Congress. In August, according to the rule, Radio Factory signed 2-year term labor contracts with the four defendants. The terms of the contracts extend from August 1, 1995 to August 1, 1997. After the expiration of the contracts, Radio Factory neither notified the four defendants to terminate the contracts, nor renewed the contracts with them, and thus a de facto labor relation was formed between the two parties. In July 1998, the Radio Factory notified the four defendants to terminate the labor contract relation on the premise of the expiration of the contract terms. The four defendants sought arbitration in the Yichang Labor Dispute Arbitration Commission, and requested the commission to maintain their original labor relationship and extend their labor contracts with Radio Factory. The commission issued the following award: the Radio Factory shall renew labor contracts of 2-year terms with the four defendants, and shall pay their social security fees. Radio Factory appealed the decision. 1995年5月,原告无线电厂按照实行全员劳动合同制的要求,制订出《宜昌市无线电厂全员劳动合同制实施细则》,经厂职工代表大会讨论通过。8月,无线电厂根据该细则,分别与4名被告签订了为期两年的劳动合同,合同期限从1995年8月1日起至1997年8月1日止。合同到期后,无线电厂没有通知4名被告终止劳动合同,也未续签劳动合同,双方形成了事实上的劳动关系。1998年7月,无线电厂以双方所签订的劳动合同已到期为由,通知4名被告终止劳动合同关系。4名被告向宜昌市劳动争议仲裁委员会申请仲裁,请求裁决维持原劳动关系,并与无线电厂续签劳动合同。劳动争议仲裁委员会裁决,无线电厂应与4名被告补签2-7年的劳动合同,并为4名被告缴纳社会保险金。无线电厂不服该裁决,遂提起诉讼。
The above facts are supported by the following evidence: the labor contracts signed during the period from the end of 1988 to the end of 1989, "The Supplementing Rules for the Labor Contract System for All Employees," the labor contracts signed in August 1995, as well as the litigants' statements. 上述事实,有1988年底至1989年底第一次签订的劳动合同、原告无线电厂制订的《全员劳动合同制实施细则》、双方当事人于1995年8月第二次签订的劳动合同以及双方当事人的陈述为证。
PROCEDURAL POSTURE 
Xiling District People's Court of Yichang City held the following view: 宜昌市西陵区人民法院认为:
According to Article 16 of Labor Law of the People's Republic of China, "labor contracts are agreements to affirm and clarify the rights and obligations of employers and employees in the labor relationship," and "labor contracts should be signed in the establishment of labor relations." The four defendants Luling, Niliang, Liushan and He Guoxiang had been employees under the labor contract system before the plaintiff began practicing the current labor contract system in 1995. According to Article 6 Subclause 2 of "The Detailed Rules for the Labor Contract System for All Employees," which was formulated by the Radio Factory and passed with due discussion in the Workers' Congress, the workers under the labor contract system should sign with Radio Factory contracts with term limits of 5 to 10 years. Therefore, the conclusion of the labor contracts with 2-year terms represents an untrue declaration of will of the four defendants, and has even violated the above Rules. Therefore, the time limits agreed upon in the contracts are void. In accordance with this, Xiling District People's Court of Yichang City issued its following judgement on May 20, 1999: 中华人民共和国劳动法》第十六条规定:“劳动合同是劳动者与用人单位确立劳动关系、明确双方权利和义务的协议。”“建立劳动关系应当订立劳动合同。”在原告无线电厂于1995年实行全员劳动合同制前,卢玲、倪亮、刘珊、何国香等4名被告就是合同制职工。按照无线电厂制订并经该厂职工代表大会讨论一致通过的《全员劳动合同制实施细则》第六条第二项的规定,合同制职工应与无线电厂签订期限为5-10年的劳动合同。无线电厂与4名被告签订为期两年的劳动合同,不是4名被告的真实意思表示,且违背了上述规定,该合同中有关劳动合同期限的约定无效。据此,宜昌市西陵区人民法院于1999年5月20日判决:
1. The claims of the plaintiff, Radio Factory , are not sustained. 一、驳回原告无线电厂的诉讼请求;
2. The plaintiff shall renew labor contracts with time limits of 2 to 7 years with the defendants Niliang, Luling, Liushan and He Guoxiang within 15 days after the effective date of the judgment. If the plaintiff fails to comply within the specified time, it shall compensate for the economic losses incurred to the defendants with payment of the standard amount of 200 RMB /month, and shall pay their social security fees until the expiration date of the contracts. 二、原告无线电厂应当于本判决生效后15日内,组织被告倪亮、卢玲、刘珊、何国香补签2-7年期限的劳动合同。原告如不在规定的时间内签订,则按200元/月的标准支付4名被告的经济损失,并为4名被告缴纳社会保险金至所签订的劳动合同期限届满为止;
