Defendant: Chen Dequn, male, 71 years old, farmer, and resident of Wenchang County, Hainan Province.@#
Third Party: Dazhipo Supply and Marketing Cooperative of Qiongshan County, Hainan Province.@#
Legal Representative: Wang Yingping, director of this cooperative.@#
Chen De'e, the plaintiff, lodged a lawsuit with the former Qiongbei Intermediate People's Court of Hainan Province against Chen Dequn, the defendant, for disputes over infringement on house ownership.@#
The plaintiff complained that: in 1946, he gave money to the defendant and entrusted him with the construction of a house at Dazhipo Weibei Street, Qiongshan County, Hainan Province. After the house was built up, the plaintiff entrusted Chen Dequn with the custody of the house, in case that the plaintiff would return to his hometown for living when he got old. In 1987, the plaintiff learned that the house had been sold by Chen Dequn to a third party, and immediately applied to the competent government department for a solution, but he got no results. So the plaintiff requested the court to order the defendant to return the house to him.@#

原告陈德俄诉被告陈德群侵害房屋所有权纠纷一案,向海南省原琼北中级人民法院提起诉讼。@#
原告诉称:1946年,原告出资委托被告陈德群在海南省琼山县大致坡圩北街建房一处。房屋建成后,原告又委托陈德群代管,以备年老返乡后居住。1987年原告得知此房被陈德群出卖给第三人,即向政府有关部门申请解决,未有结果。请求法院判令被告将此房返还原告。@#
被告辩称:原告所诉基本属实,但卖房一节事出有因。此房于1961年被台风刮坏,当时被告无钱修理,第三人大致坡供销社趁机迫使被告卖房,并将其写好的买卖契约连同买房款700元交给被告之妻。此后,该房屋由第三人占用。被告同意原告返还房屋的请求,所收房款被告可退给第三人,第三人则应将房屋返还给原告。@#
第三人称:讼争房屋是被告出租给原琼山县商业局大致坡营业部使用,后又自愿订立契约卖给营业部的,此事与第三人无关。被告辩称第三人迫其卖房不是事实。第三人不同意原告的诉讼请求。@#
琼北中级人民法院经公开审理查明:原告陈德俄与被告陈德群是同胞兄弟,原告虽在新加坡居住,但与被告之间保持着书信来往。1946年,原告出资委托被告在琼山县大致坡圩北街原22号(现24号)修建一连两进房屋一处。房屋建成后,原告口头委托被告代管。1955年5月,被告在代管期间,从1960年起以月租金10元将此房出租给琼山县商业局大致坡营业部使用。同年,此房的屋顶、门窗等被台风刮坏,营业部要求被告维修,或者由营业部自修后在房租中扣除维修费用。被告因无钱维修,提出将此房卖给营业部,并写信通知了原告。1961年8月22日,被告自愿与营业部订立买卖房屋契约,以700元价款将此房卖给营业部。营业部在买房前仅报告过大致坡公社同意,未报经县人民政府批准。营业部买房后,将房屋进行了整修,并在第二进新建房屋3间。1964年营业部撤销,将此房移交给第三人琼山县大致坡供销社使用至今。1987年,原告得知此房被代管人陈德群出卖。即向当地人民政府申请落实政策,返还房屋。后经琼山县侨务办公室查处,函复原告不予返还。原告遂向人民法院提起诉讼,请求被告返还房屋。法院受理后,追加琼山县大致坡供销社为第三人参加诉讼。@#

琼北中级人民法院认为:讼争房屋原为原告陈德俄的合法财产,原告委托被告陈德群代管。1960年该房屋被台风刮坏时,被告因无钱维修,自愿将代管房屋出卖给原琼山县商业局大致坡营业部,是无权代理的民事行为。被告在出卖房屋后,已写信告知原告,原告对此直至1987年10月前从未提出异议,应视为被告的无权代理行为事后已得到原告的默认。原琼山县商业局大致坡营业部在未报经县人民政府批准的情况下,擅自订立买卖契约购买房屋,是欠妥的。但是,鉴于营业部是在被告无钱维修的情况下买房,其行为是善意的、有偿的,买房后已将该房维修并增建了3间新房,并使用了多年,已失去返还的条件。原告对被告买房长期未表示异议、且在原房屋已不存在的情况下,提出返还房屋的诉讼请求,法院不予支持。据此,琼北中级人民法院于1990年7月26日判决如下:一、被告陈德群应将原卖房款700元付给原告陈德俄;二、琼山县大致坡圩琼北街24号讼争房屋归第三人琼山县大致坡供销社所有。@#
