| The competence of a guardian should be determined comprehensively according to such factors as the physical health and economic conditions of the guardian, and the life connection between the guardian and the ward. Where the close relatives of a minor had no competence as guardians and no other relative or friend on intimate terms with the minor was willing to serve as a guardian, the people's court may, under the principle of favoring the ward, directly designate the civil affairs department to assume the functions of social assistance and welfare to serve as the guardian of the minor and perform the duty of guardianship. | | 认定监护人的监护能力，应当根据监护人的身体健康状况、经济条件，以及与被监护人在生活上的联系状况等综合因素确定。未成年人的近亲属没有监护能力，亦无关系密切的其他亲属、朋友愿意承担监护责任的，人民法院可以根据对被监护人有利的原则，直接指定具有承担社会救助和福利职能的民政部门担任未成年人的监护人，履行监护职责。 |
