| In determining the right of revocation of a third party in a case of child support, it is necessary to clarify whether a parent's payment of child support based on his or her child support duty will infringe upon the common property right of husband and wife after the parent remarries. Although the husband and wife have the equal right to dispose of their common property, the husband or wife also has the right to reasonably dispose of his or her personal income. | | 被告尹欣怡辩称：不同意原告刘青先的诉讼请求。亲子鉴定已确定尹欣怡系被告徐飚子女。为尹欣怡的抚养事宜，徐飚与尹欣怡的母亲签订了多份协议，后因故涉诉，原告还旁听了2008年的庭审。关于尹欣怡的抚养费，法院前后有两份判决，法院的判决均是基于徐飚与尹欣怡的母亲签订的抚养协议产生的诉讼。徐飚的月收入为12．4万元，年终奖在50万至100万元，可见法院先前判决的尹欣怡的抚养费金额并未超过法律的规定，子女的抚养质量与父母的收入应该相当；原告称不了解徐飚的经济收入，说明原告夫妻的经济是分开的，徐飚有权处分自己的财产。 |

| | 2008年5月16日，尹丽芳与被告徐飚签订书面《子女抚养及财产处理协议书》，约定：尹欣怡由尹丽芳抚养，徐飚每月支付抚养费2万元，至尹欣怡20周岁时止。 2008年8月尹欣怡起诉来院[(2014)徐少民初字第60号判决]，主张徐飚在协议签订后仅支付了两个月的抚养费，要求徐飚，自2007年12月起每月支付抚养费2万元至尹欣怡20周岁。法院经审理于2008年11月20日作出判决：徐飚自2007年12月每月支付尹欣怡抚养费1万元，至尹欣怡20周岁。当事人均未上诉。 |
| | 2014年6月5日被告尹欣怡又起诉来院[(2014)徐少民初字第60号]，称2010年4月徐飚承诺将尹欣怡的抚养费增加至每月1．2万元；2011年10月徐飚再次将尹欣怡的抚养费增加至每月2万元，并履行至2014年1月，但此后徐飚未付抚养费，要求徐飚自2014年2月起每月给付尹欣怡抚养费2万元至其20周岁止。法院于2014年7月24日判决：一、徐飚于本判决生效之日起十日内按每月2万元给付尹欣怡2014年2月至2014年6月的抚养费共计10万元；二、徐飚自2014年7月起每月给付尹欣怡抚养费2万元，至尹欣怡20周岁止。判决后当事人均未上诉。 |
