Fujian Provincial Survey and Design Institute of Water Conservancy and Hydroelectric Power (hereinafter referred to as Design Institute), the plaintiff, was dissatisfied with the administrative penalty imposed by Fujian Provincial Department of Geological Mineral Resources (hereinafter referred to as the Department of GMR), and brought a lawsuit with the Intermediate People's Court of Fuzhou Municipality, Fujian Province (hereinafter referred to as Fuzhou Intermediate Court). Because the present case was relevant to the Urban and Rural Construction Commission of Fuzhou Municipality, Fujian Province (hereinafter referred to as Construction Commission) in respect of the rights and obligations under administrative law, Fuzhou Intermediate Court notified Construction Commission to participate in the litigation in the identity of the third person.@#

原告福建省水利水电勘测设计研究院（以下简称设计院）不服被告福建省地质矿产厅（以下简称地矿厅）对其作出的行政处罚，向福建省福州市中级人民法院提起诉讼。因本案与福建省福州市城乡建设委员会（以下简称城建委）有行政法律上的权利义务关系，福州市中级人民法院通知其以第三人身份参加诉讼。@#
原告诉称：一、《中华人民共和国矿产资源法实施细则》（以下简称实施细则）第四十四条规定：“地下水资源具有水资源和矿产资源的双重属性。地下水资源的勘查，适用〈矿产资源法〉和本细则；地下水资源的开发、利用、保护和管理，适用〈水法〉和有关的行政法规。”地下温泉属于水资源。对于原告开发、利用地下温泉的行为，应当依照《中华人民共和国水法》（以下简称水法）的规定，并根据《福州市地下热水（温泉）管理办法》（以下简称地下热水管理办法），由第三人予以调整。被告对不由自己主管的事务进行管理，其具体行政行为超越职权。二、《中华人民共和国矿产资源法》（以下简称矿产资源法）第四十五条规定，依照这个法律进行的行政处罚，应当由市、县人民政府决定。被告不顾管辖权限对原告处罚，其具体行政行为超越职权。三、原告没有矿山，也没有从事过开采矿产资源的活动，不属于《全民所有制矿山企业采矿登记管理暂行办法》（以下简称采矿登记办法）的适用范围。被告根据这个规定对原告进行处罚，是适用法律错误。四、被告在处罚前未调查取证，处罚后也未将处罚决定书直接送交原告，违反了法定的行政处罚程序。请求法院撤销被告的行政处罚决定。@#
被告辩称：“地热是能源矿产，应当由矿产资源法、实施细则和采矿登记办法调整。原告作为全民所有制事业单位，必须依法取得采矿权后才能采矿。被告依据采矿登记办法将原告作为行政管理相对人进行行政管理，是合法的。被告对原告两次发出通知后，原告仍不履行通知规定的义务，是违法行为，应当进行处罚。被告的行政处罚适用法规正确，程序并无不妥。法院应当依法维持该行政处罚决定。@#
