| Since 2009, Jing Jun has rented the house and courtyard of a person surnamed Gu. This courtyard was adjacent to the residence of Jiang Jianbo only by a wall and the two residences were located front and rear. In the rented courtyard, Jing Jun conducted cutting operations of iron and steel products and the noise generated thereby made Jiang Jianbo unbearable. Jiang Jianbo has successively reported this problem to the villagers' committee and local administrative department of environmental protection, but it was still not resolved yet. Therefore, Jiang Jianbo instituted a lawsuit and requested the court to order that Jing Jun should stop the infringement, eliminate obstacles, remove the iron and steel products generating noise pollution and dust pollution from the courtyard adjacent to the residence of Jiang Jianbo, and pay Jiang Jianbo 8,000 yuan for compensation for mental distress. | | 2009年起荆军租用了谷某的房屋和院落，此院落与姜建波住所前后相邻，仅一墙之隔。荆军在租用的院落里对钢铁制品进行切割作业，产生的噪声使姜建波不堪忍受。姜建波先后向村委会及当地环境保护行政主管部门反映，但问题仍未得到解决，遂提起诉讼，请求判令荆军停止侵害，排除妨碍，将产生噪声污染及粉尘污染的铁制品搬离与姜建波相邻的院落，赔偿其精神损失8000元。 |

| | 乌鲁木齐市米东区人民法院一审判令荆军立即停止侵权、排除妨害，将产生噪声的钢铁制品搬离与姜建波相邻的院落，并赔偿姜建波精神损害抚慰金2000元。荆军不服，上诉至乌鲁木齐市中级人民法院。该院二审认为，钢铁制品在装卸、运送或者加工过程中产生的声音超出一般公众普遍可忍受的程度。本案中，荆军院落与姜建波居所一墙相隔，荆军在院落中放置工具、加工材料时所产生的声音势必能传入到其他居民的居室内，已成为干扰周围居民生活的环境噪声。噪声污染对人体健康可能造成损害，是为公众普遍认可的，姜建波称其因噪声无法休息导致精神受到伤害符合日常生活经验法则，应推定属实。荆军否认噪声污染给姜建波造成了实际损害，应举证证明，但荆军不能举出其院落中发出的噪声对姜建波的身体健康未产生损害的证据。一审判决根据荆军加工钢铁制品产生的噪声的时间、两家距离的远近、噪声的大小酌情支持2000元精神损害抚慰金并无不当。二审法院于2012年7月作出判决，驳回上诉，维持原判。 |
