Li Linzhen (hereinafter referred to as Li) brought a lawsuit with the People's Court of Tonglu County, Zhejiang Province (hereinafter referred to as Tonglu County Court) against Bank of China, Tonglu Sub-branch (hereinafter referred to as Tonglu Sub-branch) due to a dispute over labor contract.@#
Li alleged: On February 24, 1994, Tonglu Sub-branch unilaterally decided to rescind the labor contract with Li on the ground that Li had no right kidney and had serious physical handicap. In medicinal clinic practices, the lack of a kidney will not seriously harm the body once the renal function is normal. The diagnosis of No. 2 Hospital Subordinate to Zhejiang Medical University proves that Li's renal function was normal and she could work normally. In respect of the nature of banking work, Li worked on banking accounting, and the lack of a kidney would not affect her work at all, or affect her external image as a bank employee. Moreover, in respect of the physical examination policies of the state, the “Physical Examination Standards for Regular Institutions of Higher Education to Recruit Students” permit anyone who lacks one kidney to take part in the examination for any major except geological majors. In view of the aforesaid reasons, Li pleaded the court to revoke Tonglu Sub-branch's decision on rescinding the labor contract with her, and to order Tonglu Sub-branch to continue performing the labor contract.@#

原告李林珍因与被告中国银行桐庐支行(以下简称桐庐支行)发生劳动合同纠纷,向浙江省桐庐县人民法院提起诉讼。@#
原告李林珍诉称:1994年2月24日,被告桐庐支行以原告缺一右肾,存在严重身体缺陷为由,单方面决定解除劳动合同。从医学临床实践看,缺一只肾,只要肾功能正常,不会对身体构成严重危害。浙江医科大学附属二院诊断证明:原告肾功能正常,可以正常工作。从银行工作性质看,原告从事的是银行会计工作,缺一只肾,根本不会对工作构成威胁,也不影响银行职员需要具备的外表形象。另外,从国家体检政策上看,《普通高校招生体检标准》允许缺一只肾的人报考除地质类以外的任何专业。鉴于上述理由,请求法院撤销被告解除与原告的劳动合同决定,责成被告继续履行劳动合同。@#
被告桐庐支行辩称:原告李林珍右肾摘除,体检时未向医师说明,到我行后,有人反映和医院复查证实。原告不符合中国银行浙江省分行《招工、招干、调入人员及新职工转正的暂行规定》(以下简称《暂行规定》)中关于新职工必须具备的“身体健康,无严重疾病和缺陷”的录用条件。根据劳动人事部有关文件规定,劳动合同制工人在试用期间,经发现不符合录用条件的,用人单位有权单方面解除其劳动合同。被告认为原告右肾摘除是严重缺陷,理由是中国银行对职工要求较高,不排除其他行业认为此类缺陷为一般缺陷而可以录用的可能性。据此,请求法院维持被告桐中银(1994)第8号关于解除李林珍劳动合同的决定。@#

桐庐县人民法院经审理查明,原告李林珍于1987年不慎从楼梯上滚下来而摔伤,在医院作了右肾切除手术。术后,恢复健康。1993年8月初,李林珍得知被告桐庐支行招工的信息,认为自己符合条件,就报了名。8月16日,桐庐支行对报名者面试后,初定李林珍可以参加体检。8月20日,被告组织初定人员到桐庐县中医院进行常规体检。李林珍体检表中载明:“既往史”栏为“无残”,“腹腔脏器”栏为“正常”,“审查意见”栏为“健康”。8月23日,桐庐支行组织李林珍等初定人员进行培训。8月28日,桐庐支行分配李林珍到其所属的横村办事处报到。9月1日,桐庐支行与李林珍签订了劳动合同。合同约定:劳动合同期为五年(自1993年9月1日至1998年8月31日);工种:业务;实行六个月的试用期;合同期间,被招合同制工人符合国务院发布的《国营企业实行劳动合同制暂行规定》(以下简称合同制规定》第十二条关于“企业可以解除劳动合同”规定的,企业可以提出解除劳动合同。该合同经李林珍、桐庐支行双方签字,并经桐庐县劳动局劳动争议仲裁科鉴证生效。12月中旬,中国银行杭州市分行电话通知桐庐支行“有人反映李林珍右肾摘除,不符合录用条件”,并要桐庐支行于1993年底前解除与李林珍的劳动合同。12月26日,桐庐支行派员带李林珍到桐庐县中医院做B超检查。结果证实:李林珍“右肾摘除,左肾正常”。1994年2月24日,桐庐支行以李林珍“右肾摘除,存在严重身体缺陷,不符合省分行《暂行规定》中的有关要求”为由,作出桐中银(1994)8号关于解除李林珍劳动合同的决定。同年8月11日,李林珍向桐庐县劳动争议仲裁委员会申请仲裁。桐庐县劳动争议仲裁委员会经对该案审理后,于12月6日作出桐劳仲案字(1994第01号仲裁裁决书:维持桐庐支行对李林珍解除劳动合同的决定。原告不服,于12月21日向法院提起诉讼。该案在审理过程中,法院委托杭州市中级人民法院法医技术处对李林珍的身体是否存在严重缺陷进行鉴定。法医鉴定结论为:被鉴定人李林珍在生理上存在缺少右肾的缺陷,但具有正常的生活能力、工作能力及社会活动能力,其身体状况未达到严重缺陷的程度。@#
