| | 2009年7月4日，滕爽与南京城际教育信息咨询有限公司（以下简称城际公司）签订辅导班报名协议书，约定滕爽花费6020元定购“报两年高年级北大附中（附小）网校赠送一个低年级网校学习”。该协议书备注栏内注明：“暑假、寒假、星期六、日辅导 初二+初一赠送六年级（包含三年所有辅导）”，辅导班地点在南京市山西路。协议签订后，滕爽依约向城际公司交纳网校辅导费6020元。2009年10月中旬，城际公司迁移到远处办班，合同约定地点的辅导班随之停办。因城际公司未能按约定提供教育服务，滕爽于2010年6月4日向江苏省南京市鼓楼区人民法院起诉，要求城际公司退还辅导费5000元。 |
