| In June 2014, Jiangxi Yingpeng Chemicals Co., Ltd. (hereinafter referred to as “Yingpeng Company”) caused leakage of waste gas in the process of production, causing damage to leaf areas of seedlings of Jiangxi Xingguang Modern Ecological Agricultural Development Co., Ltd. (hereinafter referred to as “Xingguang Company”). According to the asset appraisal report, Xingguang Company calculated the losses in proportion, which amounted to CNY3,742,600.1. | | 2014年6月，鹰鹏公司在生产中因故导致生产废气泄漏，致使星光公司苗木叶面受损，星光公司根据资产评估报告自行按比例计算损失为3742600.1元，据此诉请判令鹰鹏公司赔偿苗木损失。 |

| In the trial of first instance, the Intermediate People's Court of Ganzhou City, Jiangxi Province held that: As the tortfeasor, Yingpeng Company should assume the tort liability and compensate for losses to Xingguang Company. According to the asset appraisal report, Xingguang Company calculated the losses in proportion, which amounted to CNY3,742,600.1. Since the appraisal of the asset price conducted by the asset appraisal agency entrusted by Yingpeng Company was not an identification of losses and the asset appraisal report failed to give opinions on the identification of losses to Yingpeng Company's seedlings, the asset appraisal report could not achieve the aim of proving the amount of losses. Therefore, by reference to the proposed compensation standards of the local forestry department and in light of such actual circumstances as the area, varieties, and forest ages of the damaged seedlings of Xingguang Company, the Intermediate People's Court of Ganzhou City rendered a judgment that Yingpeng Company should compensate CNY160,000 in total for losses to Xingguang Company. | | 江西省赣州市中级人民法院一审认为，鹰鹏公司作为侵权人应当承担侵权责任，赔偿星光公司因此造成的损失，星光公司根据资产评估报告自行按比例计算损失为3742600.1元，因其委托资产评估机构所作的资产价格评估不属损失鉴定，评估报告亦未对其苗木损失作出鉴定意见，不能达到其证明损失数额的证明目的，故参照当地林业部门的建议补偿标准，结合星光公司受损苗木面积、品种、树龄等本案实际情况，判令酌定由鹰鹏公司向星光公司赔偿损失共计160000元。 |
In the trial of second instance, the Higher People's Court of Jiangxi Province held that: The asset appraisal report involved was highly credible. Although the value of losses to Xingguang Company was not directly specified in the appraisal report, according to the asset appraisal value as specified in the appraisal report and in light of the Report on Investigation into Damage to Forestry Seedlings Caused by Waste Gas Pollution by Yingpeng Company in Huichang County, Jiangxi Province issued by the Forestry Bureau of Huichang County, the value of damage to Xingguang Company may be calculated. Such information as varieties, ages, areas, numbers, and (minor, moderate, and severe) damage levels of Xingguang Company's seedlings damaged by the pollution accident involved was specified in the Registration Form for Investigation into Damage of Forestry Seedlings in the Pollution Accident Caused by Yingpeng Company in 2014. In the Detailed Statements on the Appraisal of Seedling Assets issued by the appraisal agency corresponded to the individual appraisal value for varieties of damaged seedlings as specified in the Registration Form for Investigation into Damage of Forestry Seedlings in the Pollution Accident Caused by Yingpeng Company in 2014. After the deduction of unavoidable taxes and trading costs, the total value of Xingguang Company's losses may be calculated as CNY1,363,217.29. Therefore, the Higher People's Court of Jiangxi Province rendered a judgment that Yingpeng Company should pay Xingguang Company CNY1,363,217.29 as compensation for losses to seedlings caused by the waste gas pollution.
．．．．．． | | 江西省高级人民法院二审认为，涉案资产评估报告可信程度较高，该评估报告虽未直接给出星光公司的受损价值金额，但根据该评估报告确定的资产评估价值，结合会昌县林业局出具的《关于江西会昌县鹰鹏公司废气污染林业苗木受害情况调查报告》，可以计算出星光公司的受损价值金额，会昌县林业局《2014年鹰鹏污染事故林业苗木受损情况调查登记表》中载明了星光公司因案涉污染事故而受损苗木的树种、苗龄、面积、株数、受害程度（分轻度、中度、重度三个等级）等具体信息，评估机构的《苗木资产评估明细表》对应《2014年鹰鹏污染事故林业苗木受损情况调查登记表》中载明的受损苗木的树种作出了单项评估价值，两者相结合并扣除必然发生的税费和交易成本，可以计算出星光公司的受损总值为1363217.29元，据此改判由鹰鹏公司赔偿星光公司因废气污染造成的苗木损失1363217.29元。
