 原告诉称:2012年5月,案外人亿比亚(北京)粒子加速器技术有限公司(以下简称亿比亚公司,英文名“ION BEAN APPLICATIONS CO.,LTD”)委托被告上海和明航运服务有限公司天津分公司(以下简称和明航运天津公司)将一套粒子回旋加速器(共计7个包装箱)从中国天津港经由海运运往加拿大蒙特利尔,由被告和明航运天津公司办理涉案货物的国际海运以及相关的内陆运输事宜。同年6月24日,被告和明航运天津公司安排装载该套设备主机的框架集装箱(箱号:HLXU3683746)运往其指定的中转场站等待装船出运,货物在运输过程中从承运人车辆上摔落。同年6月26日、7月4日,包括案外人亿比亚公司、深圳市万宜麦理伦保险公估有限公司上海分公司(以下简称麦理伦公估公司)、被告和明航运天津公司等在内的各方对受损的设备主机进行了联合检验。根据案外人亿比亚公司出具的监测报告和麦理伦公估公司出具的公估报告,该设备主机受损严重,已无法再行修复,故认定全损,定损金额为332656.96欧元。由于前述设备已由原告承保货物运输险,原告在依据保险合同做出赔付后依法取得了保险人的代位求偿权。原告认为涉案货物的损坏系在被告和明航运天津公司的运输责任区间内,且鉴于被告和明航运天津公司系被告上海和明航运服务有限公司(以下简称明航运公司)设立的非独立核算的分支机构,被告和明航运公司应与被告和明航运天津公司共同承担责任,请求法院判令两被告赔偿损失332656.96欧元并承担本案诉讼费。
