Where, before the receipt of the notice on enforcement from the enforcement court, the person subject to enforcement receives a notice on requiring it to directly pay off the debts as confirmed in an effective legal document to the creditor of the enforcement applicant from the enforcement court of another case and it pays off such debts, the enforcement court may not incorporate such debts that have been paid off into the scope of enforcement.

| | 中投信用担保有限公司（以下简称中投公司）与海通证券股份有限公司（以下简称海通证券）、海通证券股份有限公司福州广达路证券营业部（以下简称海通证券营业部）证券权益纠纷一案，福建省高级人民法院（以下简称福建高院）于2009年6月11日作出（2009）闽民初字第3号民事调解书，已经发生法律效力。中投公司于2009年6月25日向福建高院申请执行。福建高院于同年7月3日立案执行，并于当月15日向被执行人海通证券营业部、海通证券发出（2009）闽执行字第99号执行通知书，责令其履行法律文书确定的义务。 |
| | 被执行人海通证券及海通证券营业部不服福建高院（2009）闽执行字第99号执行通知书，向该院提出书面异议。异议称：被执行人已于2009年6月12日根据北京市东城区人民法院（以下简称北京东城法院）的履行到期债务通知书，向中投公司的执行债权人潘鼎履行其对中投公司所负的到期债务11222761.55元，该款汇入了北京东城法院账户；上海市第二中级人民法院（以下简称上海二中院）为执行上海中维资产管理有限公司与中投公司纠纷案，向其发出协助执行通知书，并于2009年6月22日扣划了海通证券的银行存款8777238.45元。以上共计向中投公司的债权人支付了2000万元，故其与中投公司之间已经不存在未履行（2009）闽民初字第3号民事调解书确定的付款义务的事实，福建高院向其发出的执行通知书应当撤销。为此，福建高院作出（2009）闽执异字第1号裁定书，认定被执行人异议成立，撤销（2009）闽执行字第99号执行通知书。申请执行人中投公司不服，向最高人民法院提出了复议申请。申请执行人的主要理由是：北京东城法院的履行到期债务通知书和上海二中院的协助执行通知书，均违反了最高人民法院给江苏省高级人民法院的（2000）执监字第304号关于法院判决的债权不适用《关于适用〈中华人民共和国民事诉讼法〉若干问题的意见》第300条规定（以下简称意见第300条）的复函精神，福建高院的裁定错误。 |
