The People's Procuratorate of Jiyuan Municipality, Henan Province lodged a prosecution to the People's Court of Jiyuan Municipality (hereinafter referred to as Jiyuan Court) against Zhao Nao, the defendant, for the crime of poisoning and the crime of sabotaging collective production.@#
The People's Procuratorate of Jiyuan Municipality prosecuted: From July to October 1995, Zhao Nao bought gas raticide and sprayed it on steamed buns or vegetable leaves, and successively threw the poison on the roads, sites or vegetable fields for 7 times in order to make profits by profiteering dead cattle. In this way, he killed 7 farm cattle of six farmers in the village including Liu Zhengyun and Zhao Fuyong, with the value at CNY 9,700. His acts violated Article 106 of the 1979 Criminal Law of the People's Republic of China, and constituted the crime of poisoning; From July 1995 to March 1996, Zhao Nao put the poison into the cattle troughs of the villagers successively for 62 times, and killed 62 farm cattle of 33 farmers including Cheng Shouxiang and Zhao She, etc. in the same way, with the value at CNY 100,780. 济源市人民检察院指控:1995年7月至10月间,被告人赵闹为了倒卖死牛牟利,购买气体鼠药洒在馍块或菜叶上,先后7次在本村路上、场地或者菜地投毒,将本村刘正云、赵富永等6户农民的7头耕牛毒死,价值9700元,其行为触犯1979年《中华人民共和国刑法》第一百零六条的规定,构成投毒罪;1995年7月至1996年3月,赵闹采取同样方法,先后62次将毒物投放在本村村民的牛槽内,将成守祥、赵社等33户农民的62头耕牛毒死,价值100780元,其行为触犯1979年刑法一百二十五条的规定,构成破坏集体生产罪。请求依法判处。@#
济源市人民法院经审理查明:1995年7月至1996年3月间,被告人赵闹为了倒卖死牛牟利,从本村商店、集体上购买气体灭鼠药,洒在菜叶上或者馍块上,将毒物投放在路边、场地、菜地或群众的牛槽中,先后毒死牛62头,价值99880元。计有马场村第二居民组周国的4头;本村第五居民组刘立的2头,杨伟的1头,刘修的2头,杨永的1头,杜木林的2头,王胜的4头,白士亮的2头,原桃的2头;第六居民组刘志富的3头,刘志贵的1头,刘军的1头,刘国营的1头,朱龙的1头,张天才的1头,刘志平的1台,白士明的2头,刘正云的2头,刘雪梅的2头,刘希堂的1头,张宗来的1头,张志铭的2头,刘迷糊的1头,周印的1头;第七居民组赵富永的1头,杨转的1头,赵发的4头,赵进的4头,赵社的6头;第八居民组赵宗保的1头,成守田的1头,成守祥的1头;第十居民组刘光平的1头,刘战的1头。赵闹倒卖了部分死牛肉,从中牟利。@#
