In respect of disputes over goods warehousing with the retrial respondent, Grain & Oil Materials Corp. of Maoming Foodstuff Bureau of Guangdong Province (the “GOMC”), the retrial petitioner, Department of Special Railway Line Operations of Maoming Supply & Sale Cooperative (the “DSRL”), against the civil judgment No. 155 [1994] of the Higher People's Court of Guangdong Province, filed a petition for retrial with the Supreme People's Court. After examination, the Supreme People's Court held that the original judgment was erroneous in the determination of the nature of the case, and decided to retry this case itself in accordance with Article 177(b) and Article 183 of the Civil Procedural Law of the People's Republic of China.@#

再审申请人广东省茂名市供销合作联社铁路专线经营部（以下简称供销专线）因与对方当事人广东省茂名市粮食局粮油物资公司（以下简称粮油公司）仓储保管货物索赔纠纷一案，不服广东省高级人民法院（１９９４）粤法经一上字第１５５号民事判决，向最高人民法院申请再审。最高人民法院经审查认为：原审判决认定案件性质错误，遂依照《中华人民共和国民事诉讼法》第一百七十七条第二款、第一百八十三条的规定，裁定对本案提审。@#
最高人民法院经审理查明：１９９３年５月，粮油公司向辽宁轮胎厂购得长征牌汽车轮胎１３０套，双方约定由辽宁轮胎厂代办托运。同年６月５日，辽宁轮胎厂向铁路朝阳西站办理了托运该１３０套轮胎至茂名火车站的运输手续，货物保价１３．９万元。该厂在货物运单上填写收货人一栏时，将“茂名市粮食局粮油物资公司”简写为“广东茂名粮油物资公司”。６月１７日，货物运抵茂名火车站，该站根据与供销专线的约定，将货车调配到供销专线卸车，双方办理了交接手续。当日，供销专线向粮油公司发出领货通知。６月１９日，粮油公司持领货凭证到茂名火车站办理领货手续时，因运单上的收货人与实际不符，未办成领货手续。６月２０日，粮油公司按茂名火车站要求出具证明办结领货手续，向供销专线交纳了专线、暂存、卸车等费用，随后去该专线仓库提货时得知货物已于６月１９日被人冒领。经查，冒领人所持运单系伪造。粮油公司遂向茂名市中级人民法院起诉，要求供销专线赔偿货损１５．１４万元，利息４万元，赔偿金５万元。@#
茂名市中级人民法院审理认为：供销专线是专门从事货物中转、仓储保管业务的企业，茂名火车站将其承运的粮油公司所有的轮胎调配到供销专线仓库存放，供销专线履行了保管义务并收取了专线费、暂存费，双方已构成仓储保管关系。供销专线应承担保管不善致使代储货物灭失和由此造成粮油公司无货供给需方的损失，遂判决供销专线赔偿粮油公司２０．１４万元及货款利息。供销专线不服该判决，向广东省高级人民法院提起上诉。@#
