 [案情]
 申请人:韩国SEKWANG船务有限公司(以下简称S公司)
 异议人:上海市环境保护局(以下简称上海市环保局)
 异议人:农业部东海区渔政渔港监督管理局(以下简称东海渔监局)
 异议人:中华人民共和国上海海事局(以下简称上海海事局)
 2002年5月17日,申请人SEKWANG船务有限公司(以下简称S公司)以其所属“大勇”轮(“DAE MYONG”)于2001年4月17日在中国长江口附近海域(离上海南汇三甲港、横沙岛只有几十海里的长江口“鸡骨礁”附近)与“大望”轮(“GREAT PRESTIGE”)发生碰撞导致重大海损为由,向上海海事法院申请设立数额为417, 333计算单位的海事赔偿责任限制基金。涉案船舶“大勇”轮已于2001年6月15日更名为“BOGHIL”轮。根据韩国釜山地区海商事务和渔政局签发的编号为01-74的船舶国籍证书记载,申请人S公司为该轮的船舶所有人。另据编号为2002-17的国际吨位证书记载,该轮总吨位为1,999吨。
 2002年6月11日,一审法院受理申请后,依照《中华人民共和国海事诉讼特别程序法》(以下简称《海诉法》)的规定,向已知利害关系人发出通知,并通过《中国日报》《解放日报》发布公告。公告期间,上海海事局、东海渔监局、上海市环保局向原审法院递交书面异议。
 异议人上海海事局称:碰撞事故发生后,我局依职权已采取应急处置强制措施,并承担了大量费用,这些费用应作为行政费用由申请人承担,而不应作为海事赔偿责任限制的对象和限制项目。请求驳回申请人设立海事赔偿责任限制基金的申请。
 异议人东海渔监局称:我局依照《中华人民共和国环境保护法》(以下简称《环境保护法》)《中华人民共和国海洋环境保护法》(以下简称《海洋环境保护法》)《中华人民共和国渔业法》(以下简称《渔业法》)对海损造成的污染事故进行了检测及分析评估,有关费用不应作为限制性债权。此外,“大勇”轮船长未经英语培训,该轮属不适航船舶。请求驳回申请人设立海事赔偿责任限制基金的申请。
 异议人上海市环保局称:该海损事故造成大量船载苯乙烯泄漏,我局依照《环境保护法》《海洋环境保护法》中华人民共和国大气污染防治法》(以下简称《大气污染防治法》)对污染事故进行了检测及分析评估,有关费用属行政干预费用,不属于海事赔偿责任限制的范围。请求驳回申请人设立海事赔偿责任限制基金的申请。
