 【裁判摘要】
Under Article 14 of the Land Administration Law and the Article 26of the Contracting of Rural Land Law, if the peasant that undertakes thecontracted land moves to and settles down in a small town, his rights tooperate the contracted land may be kept or circulated according to laws andregulations; if the land is expropriated, the peasant is entitled to appropriateexpropriation compensation.  依照土地管理法十四条和土地承包法第二十六条的规定,承包土地的农民到小城镇落户后,其土地承包经营权可以保留或者依法流转;该土地如果被征用,承包土地的农民有权获得征地补偿款。

PROCEDURAL POSTURE 
The plaintiff, Cheng Qingzong, had a dispute over the distribution of land requisition compensation with the No. 1 Villagers' Group of the Villagers' Committee of Tingyang Village (hereinafter referred to as the No. 1 Villagers' Group of Tingyang Village), the Villagers' Committee of Tingyang Village, Magang Town, Tongan District of Xiamen Municipality, Fujian Province (hereinafter referred to as the Villagers' Committee of Tingyang Village) and thus filed a lawsuit with the People's Court of Tong'an District, Xiamen Municipality. 原告陈清棕因与被告福建省厦门市同安区马巷镇亭洋村村民委员会第一村民小组(以下简称亭洋村一组)、福建省厦门市同安区马巷镇亭洋村村民委员会(以下简称亭洋村村委会)发生征地补偿款分配纠纷,向福建省厦门市同安区人民法院提起诉讼。
The plaintiff claimed that: The four family members of the plaintiff were the villagers of the No. 1 Villagers' Group of Tingyang Village. On January 5, 1996, the plaintiff, on the behalf of his family, contracted 1. 54 mu land of the No. 1 Villagers' Group, wherein the contract relationship was recognized in the No. 06627 Certificate of the Right to Contracted Management of Rural Land as issued by the People's Government of Tong'an District, Xiamen Municipality on December 31, 1998. On July 23, 2002, the Villagers' Committee of Tingyang Village concluded an agreement on land requisition with Xiamen Ruyi Food Co., Ltd (hereinafter referred to as Ruyi Food Co., Ltd), stipulating that Ruyi Food Co. Ltd should compensate for land requisition, resettlement and young crops to the Villagers' Committee of Tingyang Village before taking over for use 69. 8 mu of dry land, 1.16 mu of which had been contracted by the plaintiff. When distributing the compensations for land requisition to the villagers whose contracted land had been taken over, the No. 1 Villagers' Group of Tingyang Village failed to distribute any compensation to the plaintiff's family. Thus, the plaintiff pleaded to adjudicate that the No. 1 Villagers' Group of Tingyang Village and the Villagers' Committee of Tingyang Village pay to him the compensations for land requisition and resettlement, which amount to 17, 400 yuan in total. 原告诉称:原告一家四口是被告亭洋村一组的村民。1996年1月5日,原告代表全家承包了亭洋村一组的1.54亩土地,该土地承包关系得到厦门市同安区人民政府于1998年12月31日颁发的№066277号《土地承包经营权证》的确认。2002年7月23日,被告亭洋村村委会与厦门如意食品有限公司(以下简称如意食品公司)签订土地征用协议,由如意食品公司在向亭洋村村委会支付土地补偿款、安置款及青苗补偿款后,征用亭洋村的旱地69.8亩,其中包括原告承包的1.16亩土地。亭洋村一组在向承包土地被征用的各户村民发放土地补偿款时,不给原告一家发放。请求判令亭洋村一组和亭洋村村委会给原告支付土地征用补偿款、安置款共计17400元。
...... 被告亭洋村一组辩称:原告一家四口原来虽是本组村民,并在本组承包过土地,但自2002年1月21日,原告一家已将户口迁出本村并转为非农户。其原承包的土地,已由本组按村规民约形成的惯例,重新调整给其他村民承包。本组土地被征用后,土地补偿款、安置款等,均已如数发放给相关农户。由于自2002年1月21日后,原告已不是本集体经济组织的成员,没有承包经营的土地被征用,故无权请求分配征地补偿款。原告即使仍持有前几年发放的《土地承包经营权证》,也改变不了这一事实,因此其诉讼请求应当驳回。
 被告亭洋村村委会辩称:首先,支持亭洋村一组的答辩意见。其次,依照《中华人民共和国村民委员会组织法》第五条的规定,本村委会作为村农民集体所有土地的管理者,只是按照亭洋村一组大多数村民的意愿,履行与如意食品公司签订《土地征用协议》的手续而已。土地被征用后获得的土地补偿款,村委会已经全部交给亭洋村一组,由该组村民按照自主决策的方案全部分配。村委会没有截留这笔款项,谈不上与原告发生土地补偿款分配纠纷。原告将本村委会列为被告起诉,是错误的。请依法驳回原告的诉讼请求。
 厦门市同安区人民法院经审理查明:1996年1月5日,原告陈清棕代表全家四口人,以被告亭洋村一组村民(户别为农业户口)的身份,与亭洋村一组签订农业承包合同,承包了该组村民所有的旱地1.16亩、水田0.38亩,共计1.54亩。1998年12月31日,厦门市同安区人民政府给陈清棕发放证号为№066277的《土地承包经营权证》,确认了陈清棕一家与亭洋村一组之间的农业承包合同关系。2002年1月21日,陈清棕一家迁往同安区大同镇碧岳村岳口居住,户别也转为非农业户。陈清棕一家迁出后,亭洋村一组就将陈清棕一家原来承包的土地调整给其他村民。2002年7月23日,如意食品公司与被告亭洋村村委会签订《土地征用协议》,征用了包括陈清棕一家原来承包的1.16亩土地在内的旱地69.8亩,支付了土地补偿款、安置款及青苗补偿款。亭洋村村委会和亭洋村一组按比例将补偿款分发给被征用土地的各户村民,但未分给陈清棕一家,因此引起纠纷。2002年7月24日,陈清棕将全家户口从大同镇碧岳村岳口迁回亭洋村,户口类别仍为非农业户。2003年3月11日,陈清棕提起本案诉讼。
 厦门市同安区人民法院认为:《中华人民共和国民法通则》(以下简称民法通则)第七十一条规定:“财产所有权是指所有人依法对自己的财产享有占有、使用、收益和处分的权利。”第七十四条第二款规定:“集体所有的土地依照法律属于村农民集体所有,由村农业生产合作社等农业集体经济组织或者村民委员会经营、管理。已经属于乡(镇)农民集体经济组织所有的,可以属于乡(镇)农民集体所有。”原告陈清棕一家原来虽是被告亭洋村一组的村民,但因其一家已于2002年1月21日迁往大同镇居住,户别也转为非农户,故已丧失了作为农业人员承包土地的权利。亭洋村一组依法收回陈清棕一家承包的土地,是合理的。陈清棕一家承包该地享有的权利及应尽的义务随之消灭。此后,该承包土地于2002年7月23日被征用。陈清棕一家虽于2002年7月24日回迁亭洋村,但仍保留非农业户性质。故陈清棕请求亭洋村一组及被告亭洋村村委会给其支付征地补偿安置款,理由不能成立,不予支持。
