| (1) Basic Facts | | （一） 基本案情 |
KDF Distribution (Shanghai) Co., Ltd. (hereinafter referred to as “KDF Company”) was the holder of the word trademark of “洁水 (Aqua-scie)” and before July 1, 2013, KDF Company had the exclusive right to sell pipe products of the party not involved, Aquatherm GmbH, in China. After July 1, 2013, KDF Company terminated the cooperation agreement with Aquatherm GmbH and Aquatherm Pipe System (Shanghai) Co., Ltd. (hereinafter referred to as “Aquatherm (Shanghai) Company”) became the new agent of Aquatherm GmbH's products in China. Before July 1, 2013, the trademark “Aqua-scie” registered by KDF Company was only used for popularizing and selling Aquatherm GmbH's products. After July 1, 2013, KDF Company continued to hold the trademark “Aqua-scie” for popularizing the pipe products of other manufacturers. Aquatherm (Shanghai) Company authorized Shanghai Ousu Trading Co., Ltd. (hereinafter referred to as “Ousu Company”) to exclusively sell Aquatherm GmbH's products in the Shanghai region. In the publicity articles and leaflets, Aquatherm (Shanghai) Company and Ousu Company used such similar publicity expressions as “Originally Aqua-scie and Currently Aquatherm” and “Aquatherm (originally Aqua-scie)—The Same Quality” and such expressions as “the original agent once popularized “Aqua-scie” products in China. Since July 1, the Germany manufacturer officially started using the Chinese logo ‘阔盛' for popularization in the Chinese market” and “the original Chinese logo ‘洁水' used in China was held by the original agent and it was unrelated to Aquatherm GmbH, Aquatherm (Shanghai) Company, and their products.” KDF Company alleged that the acts of Aquatherm (Shanghai) Company and Ousu Company of using the aforesaid publicity expressions constituted infringement upon trademark right and false publicity. Therefore, it requested the court to order the two defendants to cease the acts of infringement upon trademark right and false publicity activities and compensate a total of 5 million yuan for economic losses and reasonable costs.
．．．．．． | | 开德阜公司系“洁水”文字商标的商标权人，2013年7月1日之前，开德阜公司享有案外人德国阿垮瑟姆公司水管类产品的在华独家经销权。2013年7月1日后，开德阜公司与阿垮瑟姆公司终止合作协议，阔盛公司成为阿垮瑟姆公司产品在华新代理商。开德阜公司在2013年7月1日之前，其注册的“洁水”商标仅用于推广销售阿垮瑟姆公司的产品。2013年7月1日之后，开德阜公司继续持有“洁水”商标，用于推广其他生产商的水管产品。阔盛公司授权欧苏公司在上海区域独家销售阿垮瑟姆公司产品。阔盛公司和欧苏公司在宣传文章及宣传单上使用了“原德国洁水、现德国阔盛”、“德国阔盛（原德国洁水）——不变的品质”等类似宣传用语，同时还有“原代理商曾以德国‘洁水'在华推广，从7月1日起德国厂方正式启用中文标识‘阔盛'，用于中国市场推广”、“原在华使用的中文标识‘洁水'系原代理商所持有，现已和德国阔盛、阿垮瑟姆公司及其产品无任何关联”等表述。开德阜公司认为阔盛公司、欧苏公司使用上诉宣传用语的行为构成商标侵权和虚假宣传，请求判令两被告停止侵犯商标权行为和虚假宣传行为，赔偿经济损失及合理费用共计500万元。
