| | 杜江等人申请再审称：二审判决认定事实有误，本案符合《中华人民共和国民事诉讼法》第二百条第一项、第二项、第三项、第四项的规定，请求撤销二审判决，判令殷晓俊赔偿经济损失11万元及诉讼费、律师费等合理支出费用18972元，就恶意污蔑、诽谤杜天荣人格名誉一事在《中国摄影报》、省、市级报刊、电视媒体上公开赔礼道歉。其主要理由为：1.二审认定杜江等人基于同一事实主张侵权损害赔偿系重复起诉有误。侵用他人作品和由何人提供作品系两个法律层面的问题，本案不构成重复诉讼。2.殷晓俊未经同意，违约将杜天荣摄影作品卖给他人用于宣传炒作楼盘，应当承担侵权赔偿责任。殷晓俊与昆明云秀房地产开发公司（以下简称云秀公司）所签的《转让协议》上的公章无单位名称，公司代表人汪万生的签名系殷晓俊笔迹，该协议系伪造协议，不能被认定为云秀公司使用涉案照片系得到其六人同意的主要证据。3.二审判决未判令殷晓俊承担杜江等人为维权产生的合理支出费用不当。4.杜江等人提交的录音证据证实殷晓俊公开恶意污蔑、诽谤杜天荣的人格名誉，根据侵权责任法的规定，应公开赔礼道歉。 |
