The special procedures for security interest realization newly added in China's Civil Procedure Law aim to realize a mortgager's security interests in a simpler way protect the interests of a creditor and realize security interests in a non-litigation manner. Thus where both an obligor and an obligee fail to reach an agreement on the realization of security interests the security interest holder and other persons entitled to request the realization of the security interests may directly apply to the court for auction or sale of the security property. 江苏南京鼓楼法院裁定国信担保公司对朱松年实现担保物权案


 ——民诉法新增实现担保物权特别程序的适用
 裁判要旨

 实现不动产担保物权特别程序具有非讼性,管辖异议等诉讼案件中的程序规定不应适用。如抵押房产未设定在先抵押,担保的债权确定,担保物权实现条件成就的证明材料齐备,即可裁定对抵押财产进行拍卖或变卖。不符合法律规定的,则裁定驳回申请。
 案情
 2011年11月22日,交行江苏分行与南京银硕科技实业有限公司(简称银硕公司)签订借款合同一份,约定银硕公司向交行江苏分行借款600万元。交行江苏分行与江苏省国信信用担保有限公司(简称国信担保公司)签订保证合同一份,约定国信担保公司为上述借款提供连带保证责任。银硕公司与国信担保公司签订委托担保合同一份,约定:国信担保公司为上述借款提供担保,银硕公司将多名第三人所有的南京市白下区健康路251号3单元911室、白下区致和新村6幢306室、鼓楼区中山北路283号6号楼503室、雨花台区共青团路三村2幢507室等四处房产设为抵押物,向国信担保公司提供反担保。合同签订后,交行江苏分行按约放贷。2012年1月13日,国信担保公司与朱松年签订抵押合同一份,约定:朱松年将其鼓楼区中山北路283号6号楼503室房产为反担保抵押物,为主合同中的74万元提供担保,并办理了抵押登记,该房产未设定其他在先抵押。因银硕公司未按约还贷,国信担保公司为其代偿贷款本息6211560元。国信担保公司索要代垫款项未果,遂诉至法院,申请拍卖或变卖被申请人朱松年所有房产所得价款优先受偿。
 裁判
 江苏省南京市鼓楼区人民法院经审理认为,案涉借款合同、委托担保合同、抵押合同合法有效。朱松年以其房产为反担保抵押物,并办理了登记,担保金额为74万元,且该房产没有设定其他在先抵押。国信担保公司已依约代银硕公司偿还银行借款,有权就反担保抵押房产优先受偿。
 2013年3月15日,法院裁定:准予拍卖、变卖被申请人朱松年所有的房产,申请人国信担保公司对所得款项在74万元范围内优先受偿。本裁定为终审裁定。
