| | 本院于2011年5月4日作出（2011）渝一中法刑初字第00018号刑事附带民事判决，以被告人彭治民犯组织、领导黑社会性质组织罪，组织卖淫罪，寻衅滋事罪，滥伐林木罪，高利转贷罪，行贿罪，判处无期徒刑，剥夺政治权利终身，并处没收个人全部财产。判决发生法律效力后，于2012年3月19日交付执行。该犯自投入改造以来，一直以对部分罪名有异议为由提出申诉，经重庆市高级人民法院于2017年1月23日以（2015）渝高法刑再终字第00005号刑事裁定书以容留卖淫罪、滥伐林木罪、高利转贷罪、单位行贿罪改判为有期徒刑十五年，并处罚金四百万元。现刑罚执行机关重庆市渝州监狱提出减刑建议书，报送本院审理。本院依法组成合议庭对本案进行了公开开庭审理，重庆市人民检察院第一分院指派检察员张光利、万川，刑罚执行机关重庆市渝州监狱指派工作人员程某、李某出庭履行职务，现已审理终结。 |
