(1) Basic Facts (一)基本案情
In 1936, Granville Shipping Company chartered its “Shunfeng” and “Xintaiping” to Tatung Shipping Co., Ltd. During the period of charter, these two vessels were “withheld” by the Japanese Navy and then were handed over to Tatung Shipping Co., Ltd. for continuous operation until they sank. Afterwards, Granville Shipping Company claimed for damages to these two vessels through political, diplomatic, and judicial approaches, but all failed. In December 1988, the plaintiffs, Granville Shipping Company, Chen Zhen, and Chen Chun, filed a lawsuit in the Shanghai Maritime Court, requesting the defendant, Japan Shipping Co., Ltd. (successor of Tatung Shipping Co., Ltd.) to pay charter hires and compensate for damages. During the period of litigation, Japan Shipping Co., Ltd. was changed into Mitsui O.S.K. Lines, Ltd.

 1936年,中威轮船公司将其所有的“顺丰”轮、“新太平”轮租与大同海运株式会社使用。租用期间,两轮被日本海军“扣留”,后交由大同海运株式会社继续运营至两轮沉没。中威轮船公司尔后通过政治、外交、司法等途径向日本政府索赔两轮损失,均未果。1988年12月,原告中威轮船公司、陈震、陈春就该案向上海海事法院提起诉讼,要求被告日本海运株式会社(即大同海运株式会社后身)支付租金并赔偿损失。诉讼期间,日本海运株式会社变更为商船三井株式会社。
