On the case of demurrage charges dispute with China Metals and Minerals Import and Export Corporation, the defendant Marinaviva Copania Naviera made an application to Qingdao Maritime court for the exercise of lien on cargo and detain the goods of the defendant on board keflonia Hope as a guarantee to the due demurrage charges ($ 395,600) and the ongoing demurrage charges.@#
After accepting and hearing the case, Qingdao Maritime Court found out that on Oct.,9, 1984, China Metals and Minerals Import and Export Corporation (briefly, the buyer) signed a contract note Hugo New & Sons International Sals Corp., N.Y.U.S. (briefly, the seller). It was agreed in the contract that the buyer import 24,000 tons of waste iron and steel, C&F price and 24,000 the seller arrange the chartering. The time of shipment was from Oct., 20 to Nov. 30, 1984. Port of discharge was Dalian, China. Art. 6, sect 1 of the additional clauses to the contract provided: 1,500 MTs of cargos should be unload at the port of discharge on workdays of 24 hours of continuous fine weather (except holidays). The demurrage charge was $4,500 per day. The demurrage days were counted on a continuous basis.@#

原告玛丽娜维法航运公司为与被告中国五金矿产进出口总公司滞期费纠纷一案,向青岛海事法院申请留置被告在“凯法劳尼亚”轮(KEFALONIA HOPE)上的货物,作为已到期的滞期费(三十九万五千六百美元)和继续发生的滞期费的担保。@#
青岛海事法院受理该案后,查明:一九八四年十月九日,中国五金矿产进出口总公司(以下简称买方)与美国纽约雨果父子国际销售股份有限公司(HUGO NEW &SONS INTERNATIONAL SALS CORP·)(以下简称卖方)签订一项买卖合同。合同约定买方从美国进口二万四千吨废钢铁,按成本加运费计价(C&F);由卖方租船,从美国东海岸港口装货,装运期自一九八四年十月二十日至十一月三十日,卸货港中国大连。合同附加条款的第六条第一款规定:卸货港每连续二十四小时晴天工作日应卸货一千五百公吨(节假日除外)。滞期费每日四千五百美元,滞期时间连续计算。@#
一九八四年十一月九日,卖方同巴拿马玛丽娜维法航运公司签订了租船合同,租用该公司所属“凯法劳尼亚”轮。租船合同约定,滞期费按每日四千六百美元计算;船东享有留置权。@#
“凯法劳尼亚”轮在美国罗德岛普维斯港和波士顿港将买方购买的二万四千七百五十五点五吨货物装船后,分别于一九八四年十一月二十九日、十二月六日签发了以中国对外贸易运输公司为通知人的指示提单。该轮于一九八四年十二月七日从波士顿启航,一九八五年一月十八日到达卸货港大连。该轮到港后,递交了《准备就绪通知书》,停泊在锚地等待卸货,但港口一直未予卸货。以后大连外轮代理公司通知该轮移往青岛港卸货。该轮于二月十三日到达青岛,直至三月十四日才开始卸货。一九八五年五月九日,该轮船东向青岛海事法院申请留置收货人在船上的待卸货物,并要求收货人立即支付已到期的三十九万五千六百美元的滞期费和预计至卸货完毕可能继续产生的滞期费。根据是租船合同第八条规定:“船东因运费、亏舱费和滞期费对货物享有留置权”,而且船长签发的提单上含有“合并条款”,订明“所有其它条件和除外事项依据租船合同”,租船中的滞期条款同样适用于收货人,“为确保船东收取全部滞期费,船东有权留置货物”。@#
