Where a party files an application with a Chinese court for the enforcement of an effective foreign-related arbitral award and it is found that the person subject to enforcement or the property thereof is within the territory of China, the Chinese court has enforcement jurisdiction over this case. The time limit for the party's submission of an application for enforcement to the court shall be calculated as of the date when the person subject to enforcement or the property thereof is found within the territory of China.
| | 当事人向我国法院申请执行发生法律效力的涉外仲裁裁决，发现被申请执行人或者其财产在我国领域内的，我国法院即对该案具有执行管辖权。当事人申请法院强制执行的时效期间，应当自发现被申请执行人或者其财产在我国领域内之日起算。 |

| | 上海金纬机械制造有限公司（以下简称金纬公司）与瑞士瑞泰克公司（RETECH Aktiengesellschaft，以下简称瑞泰克公司）买卖合同纠纷一案，由中国国际经济贸易仲裁委员会于2006年9月18日作出仲裁裁决。2007年8月27日，金纬公司向瑞士联邦兰茨堡（Lenzburg）法院（以下简称兰茨堡法院）申请承认和执行该仲裁裁决，并提交了由中国中央翻译社翻译、经上海市外事办公室及瑞士驻上海总领事认证的仲裁裁决书翻译件。同年10月25日，兰茨堡法院以金纬公司所提交的仲裁裁决书翻译件不能满足《承认及执行外国仲裁裁决公约》（以下简称《纽约公约》）第四条第二点关于“译文由公设或宣誓之翻译员或外交或领事人员认证”的规定为由，驳回金纬公司申请。其后，金纬公司又先后两次向兰茨堡法院递交了分别由瑞士当地翻译机构翻译的仲裁裁决书译件和由上海上外翻译公司翻译、上海市外事办公室、瑞士驻上海总领事认证的仲裁裁决书翻译件以申请执行，仍被该法院分别于2009年3月17日和2010年8月31日，以仲裁裁决书翻译文件没有严格意义上符合《纽约公约》第四条第二点的规定为由，驳回申请。 |
