The work safety license of the Xinxing Coal Mine had expired and had been seized temporarily due to its failure to establish in the mine a permanent ground gas drainage system. From January 13, 2009 to September 18, 2009, the Coal Mine Safety Administration of Heilongjiang Province and its branch in Hebin ordered the Xinxing Coal Mine to stop production for rectification for seven times, however, the Xinxing Coal Mine refused to observe the order. The Xinxing Coal Mine failed to drill advance boreholes according to operating regulations during the coal exploring way construction over the No. 113 workface on the third level of the mine, in violation of regulations on operations. From September 10, 2009 to October 18, 2009, the Xinxing Coal Mine Hidden Risk Detection and Removal Meeting and the Mining Affairs Conference listed the failure to drill advance boreholes over the No.113 workface on the third level of the Xinxing Coal Mine as a major potential safety risk, and affirmed that defendant Xie Rongren (deputy chief of the coal mine), who was in charge of the “one ventilation and three preventions” work, was to be responsible for rectification, but defendant Xie Rongren failed to make rectifications; defendant Yue Chaosheng (chief of the coal mine) failed to supervise the implementation of rectifications; and defendant Dong Qinkui (convicted), chief engineer responsible for technical management of the entire coal mine, and defendant Liu Zongtuan (convicted), supervision director in charge of safety supervision and inspection, also failed to require the hidden risk unit to implement rectifications. Zhang Lijun and Wang Shou'an (both convicted), chief and deputy chief of the No. 2 exploration area, continued to carry out construction work over the No. 113 workface on the third level. At 2:00 a.m. on November 21, 2009, a coal and gas outburst accident occurred during operations over the No. 113 workface on the third level. Yue Chaosheng and Xie Rongren, who were in command on-site, did not order power on the second level to be cut off, which resulted in the outburst gas, from the No. 113 workface on the third level, entering the workface on the second level and exploding after it came into contact with an electric spark. The accident caused the death of 108 people and the injury of 133 people (six of whom were seriously injured), with direct economic losses of 56.1465 million yuan.

新兴煤矿因未建立地面永久瓦斯抽放系统、安全生产许可证已过期且被暂扣。2009年1月13日至9月18日，黑龙江省煤矿监察局及其鹤滨监察分局7次责令新兴煤矿停产整改，但新兴煤矿拒不执行。新兴煤矿三水平113工作面探煤巷施工中未按作业规程打超前钻探，违章作业。同年9月10日至10月18日，新兴煤矿隐患排查会及矿务会三次将三水平113工作面未打超前钻探措施列为重大安全隐患，均确定负责“一通三防”工作的被告人谢荣仁（副矿长）为整改责任人，但谢荣仁未予整改，被告人岳超胜（矿长）没有督促落实，负责全矿技术管理工作的总工程师董钦奎（已判刑）和负责安全监督检查工作的监察处长刘宗团（已判刑）亦未要求隐患单位整改落实。二开拓区区长、副区长张立君、王守安（已判刑）继续在三水平113工作面违章施工作业。同年11月21日2时，三水平113工作面作业中发生煤与瓦斯突出事故，岳超胜、谢荣仁现场指挥中未下令切断二水平电源，致使三水平113工作面突出的瓦斯进入二水平工作面，遇电火花后发生爆炸，造成108人死亡、133人受伤（其中重伤6人），直接经济损失5614.65万元。
