| | 原审法院查明，2003年10月16日，吴欣代表被告向原告确认汤亮一行8人英国旅游团费为8，247美元。2003年10月13日，上海市工商行政管理局出具《企业名称变更核准通知书》，同意被告的企业名称由上海衡山国际旅游有限公司变更为上海东星国际旅行社有限公司。吴欣从2001年9月1日起任被告公司总经理助理兼海外部经理职务。2003年12月11日，被告对吴欣发出停职停薪通知。2003年9月28日、10月27日，正方形公司分别向被告支付了人民币72，796.80元和66，887元。被告出具了相应的发票。正方形公司出具证明该单位于2003年10月组织汤亮等人赴英国考察，由被告组团、原告接待，并在当年与被告结清所有团费。 |
| | 原审法院认为，原、被告间虽没有书面的委托带团的旅游合同，但是，从双方对旅游团行程安排的往来传真、吴欣和正方形公司的证明、被告开给正方形公司发票和后者的付款，均相互印证，证明被告委托原告在英国接待正方形公司一行8人旅行。本案的关键证据是吴欣对原告团费函的确认。吴欣在2003年10月16日担任被告的总经理助理和海外部经理职务，其对该团费的确认是职务行为，应予确认。被告应该向原告支付该笔团费。遂原审法院于2005年9月22日依据《中华人民共和国合同法》第一百零九条之规定，判决：一、被告在判决生效后十日内给付原告旅游团费8，247美元；二、原告要求被告支付利息损失的诉讼请求，不予支持。案件受理费人民币2，713元，由原告负担人民币150元，被告负担人民币2，563元。 |
