Defendant: Yang Mingji, male, 34 years old, former deputy chief of Sanzao Frontier Defense Battalion of Frontier Defense Substation of the Public Security Bureau of Zhuhai City, Guangdong Province, and was arrested on August 24th, 1993.@#
Defendant: Lin Shouru, male, 29 years old, secretary of Nanshui Police Station of Frontier Defense Substation of the Public Security Bureau of Zhuhai City, Guangdong Province, and was arrested on August 24th, 1993.@#
PROCEDURAL POSTURE@#
The People's Procuratorate of Zhuhai City, Guangdong Province instituted a public prosecution to the Intermediate People's Court of Zhuhai City, Guangdong Province against Yang Mingji and Lin Shouru for their crime of smuggling.@#
Upon trial, the Intermediate People's Court of Zhuhai verified that:@#
During the period when he was holding the position of the deputy chief of Sanzao Frontier Defense Battalion of Frontier Defense Substation of the Public Security Bureau of Zhuhai City, Guangdong Province, and was in charge of suppressing smuggling, to seek exorbitant profits, Yang Mingji conspired with Kuang Jianzhong, Chen Guangxian and Lin Jianyi (to be punished in other cases) to smuggle cigarettes from Macau to Sanzao of Zhuhai City and handed them over to Huang Zhunan, et al. (to be punished in other cases) for distribution. Yang Mingji charged escort fees for sending personnel and speed boats to escort the ship loaded with cigarettes to the port of Sanzao. Yang Mingji and Kuang Jianzhong also rent the ship “Zhusanyun No.06014” at Wanzai of Zhuhai City for loading cigarettes. Then, by collaborating with Lin Shouru and in the name of uting tasks, Yang Mingji assigned Zhang Jiehua, Zhang Bin and Xiao Guicai (to be punished in other cases) to reinforce in policeman uniforms and carry guns near Jiu'ao deep water wharf of Macau and secure the ship carrying cigarettes until it arrived at the port of Sanzao. From March 8th to 28th, 1993, Yang Mingji smuggled 2300 boxes of cigarettes with a total value of 5,175,000 yuan for four times by collaborating with Lin Shouru and assigning Zhang Jiehua, Zhang Bin and Xiao Guicai. Yang Mingji himself obtained 48,200 yuan of illicit money. Lin Shouru participated in the smuggling of cigarettes which was covered by armed force for five times since March 8th to April 3rd, 1993, involving 2900 boxes of cigarettes with a total value of 6.525 million yuan, and he himself obtained 43,300 yuan of illicit money. After the case was put on record, Yang Mingji surrendered 20,000 yuan of illicit money, and Lin Shouru surrendered 42,800 yuan of illicit money.@#

广东省珠海市人民检察院以被告人杨明基、林寿儒犯走私罪，向广东省珠海市中级人民法院提起公诉。@#
珠海市中级人民法院经审理，查明：@#
被告人杨明基在任广东省珠海市公安局边防分局三灶边防大队副大队长、负责辑私工作期间，为牟取暴利，于１９９３年２月间，与走私分子邝建中、陈光贤、林建毅（均另案处理）共谋走私，商定从澳门偷运香烟到珠海三灶给走私分子黄铸南等人（另案处理）销售。由杨明基派人、派快艇护送装载香烟船只到三灶码头，从中收取押运费。杨明基还与邝建中在珠海市湾仔租用了装载香烟的“珠三运０６０１４”号船只。尔后，杨明基串通被告人林寿儒，以出海执行任务为名，指派警士张杰华、张彬、肖桂财（均另案处理），穿警服带枪支，驾驶快艇到澳门九澳深水码头附近海面接应，武装掩护运载走私香烟船只到三灶码头。同年３月８日至２８日，杨明基先后四次率领林寿儒及警士张杰华、张彬、肖桂财共计走私香烟２３００箱，总价额人民币５１７．５万元，其个人获赃款４８，２００元。被告人林寿儒自同年３月８日至４月３日，先后参与用武装掩护走私香烟五次，共计２９００箱，总价额人民币６５２．５万元，其个人获脏款４３，３００元。案发后，被告人杨明基退脏款２万元，被告人林寿儒退脏款４２８００元。@#
上述事实，有查获用于运输走私香烟的“珠三运０６０１４”号船只、押运走私香烟快艇等物证和书证，证人证言等证实。@#
珠海市中级人民法院认为：被告人杨明基、林寿儒身为国家公安边防人员，在负责缉私工作期间，为牟取非法所得，竟执法犯法，违反海关法规，利用职务之便，为走私分子武装掩护走私香烟，其行为均已构成《全国人民代表大会常务委员会关于惩治走私罪的补充规定》（以下简称《规定》）第四条第（１）规定的走私罪。杨明基在共同走私犯罪中起策划和组织作用，依照刑法第二十三条规定是本案主犯，应当依法从重处罚。林寿儒在共同走私犯罪中起次要作用，依照刑法第二十四条第一款的规定是本案从犯，依照该条第二款规定，应当比照主犯减轻处罚。被告人杨明基犯走私罪，其掩护走私物品价额特别巨大，情节特别严重，应依照《规定》第四条第（１）项的规定予以处罚，并没收其个人财产，依照刑法第五十三条第一款的规定，对杨明基剥夺政治权利终身；被告人林寿儒犯走私罪，其参与掩护走私物品价额巨大，鉴于系本案从犯，应当依照《规定》第四条第（１）项的规定，比照主犯杨明基减轻处罚，并没收个人财产，依照刑法第五十三条第一款的规定，对林寿儒剥夺政治权利终身。@#
