| | 英力士公司以化工公司、化工研究院、顾军民、徐永通、熊瑾、张斌为被告，向一审法院提起诉讼，请求判令六被告立即停止使用本案所涉技术秘密并向其返还相关文件、图纸、数据等材料，赔偿其经济损失人民币2亿元，赔偿其为制止侵权行为而支出的律师费、公证费、鉴定评估费、翻译费等合理费用人民币100万元等。一审法院受理后，化工研究院在提交答辩状期间对本案管辖权提出异议，理由是：本案系一起复杂的合同、侵权竞合引发的仲裁管辖与必要共同侵权诉讼管辖相冲突的案件，在案外人中石化宁波工程有限公司（以下简称宁波工程公司）未成为本案被告的情况下，本案无法确定相关案件事实，故应当依法驳回英力士公司的起诉。 |
| | 一审法院认为：因侵权行为提起的诉讼，由侵权行为地或被告住所地人民法院管辖。本案被告化工公司的住所地在中华人民共和国北京市朝阳区，故该院依法对本案具有管辖权。被告化工研究院提出的管辖权异议的理由，实质上并非系对该院是否对本案具有管辖权提出的异议，故其相关理由缺乏法律依据，不予支持。该院依照《中华人民共和国民事诉讼法》第二十八条、第一百二十七条第一款、第一百五十四条第一款第（二）项之规定，裁定驳回化工研究院的管辖权异议。 |
