基本案情@#
被告人杨延虎1996年8月任浙江省义乌市委常委，2003年3月任义乌市人大常委会副主任，2000年8月兼任中国小商品城福田市场（2003年3月改称中国义乌国际商贸城，简称国际商贸城）建设领导小组副组长兼指挥部总指挥，主持指挥部全面工作。2002年，杨延虎得知义乌市稠城街道共和村将列入拆迁和旧村改造范围后，决定在该村购买旧房，利用其职务便利，在拆迁安置时骗取非法利益。杨延虎遂与被告人王月芳（杨延虎的妻妹）、被告人郑新潮（王月芳之夫）共谋后，由王、郑二人出面，通过共和村王某某，以王月芳的名义在该村购买赵某某的3间旧房（房产证登记面积61.87平方米，发证日期1998年8月3日）。按当地拆迁和旧村改造政策，赵某某有无该旧房，其所得安置土地面积均相同，事实上赵某某也按无房户得到了土地安置。2003年3、4月份，为使3间旧房所占土地确权到王月芳名下，在杨延虎指使和安排下，郑新潮再次通过共和村王某某，让该村村民委员会及其成员出具了该3间旧房系王月芳1983年所建的虚假证明。杨延虎利用职务便利，要求兼任国际商贸城建设指挥部分管土地确权工作的副总指挥、义乌市国土资源局副局长吴某某和指挥部确权报批科人员，对王月芳拆迁安置、土地确权予以关照。国际商贸城建设指挥部遂将王月芳所购房屋作为有村证明但无产权证的旧房进行确权审核，上报义乌市国土资源局确权，并按丈量结果认定其占地面积64.7平方米。@#
