1. In the constitution of a crime of embezzlement, "taking advantage of one's position" means taking advantage of the powers in one's position to take charge of, manage and handle public property and the related conveniences, including not only taking advantage of one's own position in taking charge of and managing public property but also taking advantage of the positions of other state personnel with a subordinate relationship in positions.
 1.贪污罪中的“利用职务上的便利”,是指利用职务上主管、管理、经手公共财物的权力及方便条件,既包括利用本人职务上主管、管理公共财物的职务便利,也包括利用职务上有隶属关系的其他国家工作人员的职务便利。
