[Judgment abstract] [裁判摘要]
(1) An effective ruling of compensation and resettlement for housing demolition and relocation is the basis for compulsory housing demolition and relocation. After the ruling of compensation and resettlement for housing demolition and relocation is revoked by the court of first instance, compulsory housing demolition and relocation should no longer be implemented. 一、生效的拆迁补偿安置裁决是实施强制拆迁的基础,拆迁补偿安置裁决被一审撤销后,强制拆迁不得再继续实施。
(2) A comment agreeing with compulsory housing demolition and relocation signed by a person in charge of a people's government at the county level should not replace a decision ordering housing demolition and relocation within a time limit which should be made in writing upon legal procedures. 二、县级人民政府负责人签署的同意强制拆迁的意见,不能代替应经法定程序并应以书面形式作出的责令限期拆迁决定。

 申请再审人于栖楚因诉被申请人贵阳市住房和城乡建设局(原贵阳市房地产管理局,以下简称贵阳市住建局)强制拆迁一案,不服贵州省高级人民法院(2000)黔行再终字第2号行政判决,向本院申请再审。本院经审查认为原生效判决存在适用法律错误的情形,以(2011)行监字第410号行政裁定提审本案。现已审理终结。
 
 贵州省高级人民法院(2000)黔行再终字第2号行政判决查明:1993年贵州汉方房地产开发公司(以下简称汉方公司)经贵阳市人民政府有关部门批准,在贵阳市省府北街及其相邻地段修建商住楼。1995年 6月该公司领取拆迁许可证。于栖楚私房位于拆迁范围。汉方公司因未能与于栖楚就安置补偿达成一致,向贵阳市住建局(当时为贵阳市房地产管理局)申请裁决。贵阳市住建局于1996年3月11日作出(1996)筑迁裁字第9号裁决,由汉方公司在贵阳市花溪大道北段730号“贵溪商住楼”安置被拆迁人于栖楚。于栖楚在裁决规定的搬迁期限内未搬迁,向贵阳市云岩区人民法院提起行政诉讼,请求撤销该裁决。同年3月22日,汉方公司申请强制执行该裁决。贵阳市房屋拆迁安置管理处(以下简称贵阳市拆迁处)、贵阳市住建局审核同意后上报贵阳市人民政府。经贵阳市人民政府审批决定后,贵阳市住建局以贵阳市拆迁处名义于6月18日张贴(1996)筑迁执告字第9号拆迁公告,称根据《城市房屋拆迁管理条例》和《贵阳市建设拆迁管理办法》的有关规定,限被拆迁人于同年6月20日前搬迁完毕,逾期不搬将强制搬迁。因于栖楚到期仍未搬迁,贵阳市拆迁处于6月24日对于栖楚的房屋进行了强制拆迁。于栖楚对强制拆迁行为不服,向贵阳市中级人民法院提起诉讼,形成本案。
 贵阳市中级人民法院(1998)筑行初字第2号一审判决认为:贵阳市拆迁处以(1996)筑迁执告字第9号公告对于栖楚的房屋进行拆迁,违反了《城市房屋拆迁管理条例》的规定,其辩称强拆行为系由政府授权的理由不能成立;贵阳市拆迁处系贵阳市住建局的内设机构,不具有行政执法主体的资格,其行为后果应由贵阳市住建局承担。该院遂判决撤销1996年6月24日对于栖楚所作的强制拆迁行为。一审案件受理费人民币100元,由贵阳市住建局负担。
 贵阳市住建局不服该判决,向贵州省高级人民法院提起上诉。该院(1998)黔行终字第12号行政判决认为:贵阳市拆迁处作为贵阳市住建局的内设机构,以拆迁公告方式对被拆迁人的房屋进行强制拆迁,其行为违反了《城市房屋拆迁管理条例》的规定,一审判决认定事实清楚,审判程序合法,适用法律基本正确,应予维持。故判决驳回上诉,维持原判。一、二审案件受理费人民币200元,由贵阳市住建局负担。
