(1) Basic Facts 一、基本案情
From July 9 to 11, 2014, in order to force the No. 6 People's Hospital of Anyang City, Henan Province to make compensation for the death of a patient surnamed Zhao, defendants Zhao Juntang, Han Jinyan, Zhao Shifeng, Fan Changxi, Guo Yongjun, Guo Honghai, Zhao Liqing, and Zhao Danzhi assembled their relatives and friends, over 30 persons in total, to place Zhao's corpse in the Out-Patient Hall of the No. 6 People's Hospital of Anyang City, block the front door of the In-Patient Department with motor vehicles, hang a banner, set up a mourning hall, and burn paper money, which have caused medical personnel's failure to work normally and severely disturbed the normal medical order of the No. 6 People's Hospital of Anyang City. On July 11, they obstructed police officers from Wenhui Branch of the Public Security Bureau of Anyang City, who came to the scene to persuade them to leave, from performing their official business by means of tearing such police officers' cloths, catching and beating up them, and injured police officers Xing and Jin, whose injuries were identified by judicial doctors as slight ones. When the police officers persuaded them to leave the scene and cleared the constant temperature coffin, burned paper, and other articles, Fan Changxi, Guo Yongjun, Guo Honghai, and Zhao Liqing refused to cooperate and obstructed such police officers in every possible way in conducting their normal work, which have severely obstructed such police officers from performing their official business. 2014年7月9日至7月11日期间,为迫使河南省安阳市第六人民医院对患者赵某某的死亡进行赔偿,被告人赵君堂、韩金言、赵湿峰、樊长喜、郭拥军、郭红海、赵利清、赵丹只聚集其亲戚朋友30余人将患者赵某某的尸体停放在安阳市第六人民医院门诊大厅内,并以汽车堵住住院部大门、悬挂横幅、设置灵堂、烧纸等方式致使医护人员无法正常工作,严重扰乱了安阳市第六人民医院正常的医疗秩序。7月11日,对前来劝解的安阳市公安局文惠分局民警采取撕扯、抓打等方式,阻碍公安民警执行公务,并将民警邢某某、晋某某打伤,经法医鉴定构成轻微伤。在公安民警进行劝离、清理恒温棺、烧纸等物品时,樊长喜、郭拥军、郭红海、赵利清四人拒不配合,并对民警的正常工作百般阻挠,严重阻碍公安民警执行公务。
