| | 申请人钟某芳与被申请人陈某于2010年2月2日经法院判决离婚，子女由钟某芳抚养。判决生效后，陈某拒不搬出钟某芳房屋，还要求与钟某芳同吃、同睡，限制钟某芳的人身自由和社会交往。钟某芳稍有不从，就遭其辱骂和殴打，并多次写字条威胁钟某芳。法院强制其搬离后，他仍然借探视子女为由，多次进入钟某芳家中对其实施威胁，还经常尾随、监视钟某芳的行踪，不仅使钟某芳的身体受到伤害，还使其处于极度恐惧之中。钟某芳于2010年5月6日向法院提出了人身安全保护裁定的申请，并提交了报警证明、妇联的来访记录、被申请人威胁申请人的字条、被撕烂的衣物、照片等证明材料。 |
