| | 法院经审理查明：1998年元旦前，被告人李振国从东北回到山东老家祭祀。同年1月5日下午，李振国得知同村女青年李某某的父母均在外地打工，李某某独自在家的消息后，产生强奸念头。当日19时许，李振国拨开大门的门闩后进入李某某家中，正在西屋洗头的李某某发现后喊叫，李振国遂躲入东屋。李某某边喊边进入东屋，李振国抓着李某某的头发将其摔倒在地，用石块、手电筒、拳头击打李某某的头部，用手掐李某某的颈部，致李某某昏迷。之后，李振国将李某某抱到堂屋内的床上强奸。作案后，李振国见李某某已死亡，遂将尸体藏匿于李某某家堂屋东套间地窖内，将大门锁好后逃离现场。经鉴定，被害人李某某系被他人用质地较硬的钝器打击头部致严重颅脑损伤死亡。2011年12月8日，李振国在吉林被公安机关抓获归案。 |
