Vessel M.V. AGAMEMNON of the defendant weighed anchor at floats No. 34-35 on Shanghai's Huangpu river and sailed toward floats No. 73-74 at a low speed, towing an anchor in the water at 15:10, Nov.22, 1984. While she was passing float No. 70, the man on duty at the plaintiff's cable waterline watching station found that the left anchor of the vessel was in the water. The man immediately switched on the neon signed marked with "water-line" to give out signals. Meanwhile, he called out through loudspeakers to the vessel and demanded that the anchor be taken in. Yet, no response came from the vessel and she sailed on with the anchor under waterline. At 16:52, the left anchor broke subaqueous cable Nanpu 383 which crossed the river. This accident caused the split of the live wire entanglement and generating set No.7 of Shanghai Power-Supply Bureau's subordinate Power Supply Office, high voltage work area and Nanshi Power Station. The above led to power cut in the Surrounding areas and 14 factories had to stop their production.@#

被告所有“阿加米能”轮（Ｍ·Ｖ·ＡＧＡＭＥＭＮＯＮ）于一九八四年十一月二十二日十五时十分，从上海港黄浦江３４－－３５号浮筒起锚，慢速驶向７３－－７４号浮筒，由于该轮拖锚航行，当驶过７０号浮筒时，原告的电缆水线守望站值班员发现该轮左锚在水中，立即开亮标有“水线”的霓红灯警告牌以示警告，并通过扩大机不断向该轮呼叫，要求该轮将锚收起，但该轮毫无反应，继续施锚航行，以致在十六时五十二分，左锚将敷设在７２－－７３号浮筒间的“南浦３８３”号水底过江电缆钩断，致使上海供电局所属供电所、高压工区以及南市发电厂７号发电机组与电网解列，造成附近部分地区停电，十四家工厂停产。@#
十一月二十三日，上海供电局向上海海事法院申请诉前保全，诉称：巴拿马波罗的斯船务公司所属“阿加米能”轮因在黄浦江中拖锚航行，钩断７２－－７３号浮筒之间的过江电缆，造成申请人设备损失、供电损失、用户因停电造成的损失共计人民币三十万元，要求被告提供银行担保，否则扣押“阿加米能”轮。同日，上海海事法院接受上海供电局的诉前保全申请，并通知申请人提供有关证据材料；十一月二十六日，裁定被申请人必须在收到裁定书后五日内，通过中国银行或中国人民保险公司提供相当于人民币三十万元的担保；在被申请人提供担保前，“阿加米能”轮不得离开中华人民共和国上海港；如被申请人不提供担保，将依法扣押被申请人所有的“阿加米能”轮。十一月二十七日，中国人民保险公司上海市分公司受托，代表被申请人的船东提供了担保。同日，上海供电局向上海海事法院提起诉讼，要求波罗的斯船务公司赔偿经济损失共计人民币三十三万零二十三元四角六分。@#
