PROCEDURAL POSTURE@#
Beijing Yierku Science & Trade Co., Ltd. (hereinafter referred to as Yierku) was dissatisfied with the Decision on Administrative Punishment No. 97 (2003) as made by the Administrative Bureau for Industry and Commerce of Wuxi City, Jiangshu Province (hereinafter referred to as the Bureau) and thus filed an action with the People's Court of Chong'an District, Wuxi City, Jiangshu Province on June 3, 2004.@#
The plaintiff alleged that: It imported a batch of styrene butadiene rubber (hereinafter referred to as the SBR) from Russia, which passed the examination on qualification inspection conducted by the state administrative department of inspection and quarantine. The SBR was kept in the warehouse of the Railway Transportation Branch under Wuxi Warehousing and Transportation Co., Ltd. (hereinafter referred as Wuxi Warehousing and Transportation Co., Ltd.) and was not yet sold out. The defendant detained and sealed up the SBR on the ground that the product mark failed to satisfy the relevant requirements. After detainment, the defendant failed to notify the plaintiff in a timely manner. On December 29, 2003, the Bureau imposed upon the plaintiff an administrative penalty of 119, 000 yuan by the Decision on Administrative Punishment No. 97 (2003). Article 26 of the Provisions on the Mark and Label of Products explicitly prescribes: “The power to interpret the present Provisions shall remain with the State Administration of Technical Supervision.” Namely, any issue regarding the mark and label of products shall be put under charge of the State Administration of Technical Supervision rather than the administrative organ for industry and commerce. Furthermore, the administrative organ for industry and commerce can only conduct supervision and examination on the goods that have entered into circulation. The plaintiff's SBR was kept in the warehouse outside circulation and thus was not any target subject to the defendant's law enforcement. The defendant abused its power and overstepped its power by unlawfully detaining and sealing up the plaintiff's assets, which was an unlawful punishment against the plaintiff, thereby injuring the legitimate rights and interests thereof. The plaintiff pleaded with the court to revoke the Decision on Administrative Punishment No. 97 (2003) as made by the defendant.@#

扣留、查封与行政处罚,是各自独立的具体行政行为。行政机关已经向行政管理相对人告知了复议权、诉讼权以及起诉期限,行政管理相对人在法定期限内对扣留、查封不行使复议或起诉的权利,却在请求撤销行政处罚决定的行政诉讼中指控扣留、查封违法。根据行政管理相对人的诉讼请求,人民法院只审查行政处罚行为的合法性。@#
根据产品质量法和《国家工商行政管理总局职能配置内设结构和人员编制规定》的规定,商品一旦进入流通领域,无论是在仓库中、货架上还是在其他地点存放,其质量均由工商行政管理部门进行监督管理。@#
限期使用的进口产品外包装上没有中文标识,外文标识上没有安全使用期或者失效日期,生产日期不完整,是不符合产品质量法二十七条规定的产品。销售者销售这种违法产品情节严重的,根据产品质量法三十六条规定,应当承担产品质量法五十四条规定的违法责任。@#

原告北京伊尔库科贸有限公司(以下简称伊尔库公司)不服被告江苏省无锡市工商行政管理局(以下简称无锡市工商局)对其做出的锡工商案(2003)第97号行政处罚决定,于2004年6月3日向江苏省无锡市崇安区人民法院提起诉讼。@#
原告诉称:原告从俄罗斯进口的一批丁苯橡胶,经国家商检部门确认产品质量合格。这批丁苯橡胶存放在无锡储运有限公司铁路运输分公司(以下简称无锡储运公司)仓库,并未销售。被告以产品标识不符合要求为由,将这批丁苯橡胶扣留、查封,扣留后还不及时通知原告。2003年12月29日,被告又以锡工商案(2003)第97号处罚决定书,对原告作出罚款119000元的行政处罚。《产品标识标注规定》第二十六条明确规定:“本规定由国家技术监督局负责解释。”这就是说,有关产品标识标注方面的问题,是由国家技术监督局主管,不是工商行政管理机关的份内职责。再有,工商行政管理机关只能对进入流通领域的商品进行监督检查,原告的丁苯橡胶在仓库存放,没有进入流通领域,不是被告的执法对象。被告滥用职权、越权办案,违法扣留、查封原告的财产,违法处罚原告,侵犯了原告的合法权益。请求撤销被告作出的锡工商案(2003)第97号行政处罚决定。@#

2.2001年11月16日国务院以第322号令发布的《规章制定程序条例》,用以证明行政规章的制定,体现行政机关的职权与责任相统一;行政规章的解释权属于规章制定机关;其他国家机关认为行政规章同法律、行政法规相抵触,可以向国务院书面提出审查建议,由国务院法制机构研究处理。@#
3.《中华人民共和国行政处罚法》第十条,用以证明被告扣留货物后不及时通知伊尔库公司是违法行为。@#
被告辩称:丁苯橡胶是原告进口后用于销售的商品,属于《中华人民共和国产品质量法》(以下简称产品质量法)调整的范围。这批丁苯橡胶是限期使用商品,其产品标识不符合产品质量法二十七条的规定。被告依照产品质量法规定处罚原告的违法行为,所依据的事实是清楚的,证据是确实的,适用法律、法规是正确的,且符合法定程序。在对违法行为给予行政处罚的同时,被告尽可能地维护了原告的合法权益,执法目的是端正的。被告依法作出的行政处罚决定,不存在滥用职权和越权行政问题,法院应当维持。@#
