| | 2011年10月18日下午，汪毓兰在武汉汉福超市有限公司光谷分公司（以下简称汉福公司）开办的家乐福光谷店购物，见促销员推荐西麦麦片“买五赠一”活动，遂购20袋，并在促销员协助下，将24袋麦片装入购物袋。结账时，汪毓兰与收银员为没有粘贴赠品标签的4袋麦片是否应付款而发生争执。店内的保安将原告汪毓兰及选购的物品带至该店风险预防办公室。汪毓兰辩解4袋麦片系赠品，无需付款。保安在店内两名工作人员陈述麦片没有做赠送活动后，对汪毓兰及选购的商品拍照，并要其在一张表格上签名。汪毓兰患有眼疾，并未看清具体内容即签名。此后，促销员将“非卖品”标签贴在4袋麦片上，带汪毓兰结了账。 |
