PROCEDURAL POSTURE | |
河北省石家庄市中级人民法院审理石家庄市人民检察院指控被告人王海生犯故意伤害罪，附带民事诉讼原告人提起附带民事诉讼一案，于2003年1月26日以(2002)石刑初字第166号刑事附带民事判决，认定被告人王海生犯故意伤害罪，判处有期徒刑十年，剥夺政治权利三年；赔偿附带民事诉讼原告人经济损失5000元。宣判后，王海生不服，提出上诉。河北省高级人民法院于2003年9月11日以(2003)冀刑一终字第498号刑事裁定，撤销原判，发回重审。石家庄市中级人民法院于2003年11月7日以(2003)石刑初字第262号刑事附带民事判决，认定被告人王海生犯故意伤害罪，判处有期徒刑十年，剥夺政治权利二年；赔偿附带民事诉讼原告人5000元。宣判后，王海生不服，提出上诉。河北省高级人民法院于2004年6月24日以(2004)冀刑一终字第176号刑事判决，认定被告人王海生犯故意伤害罪，在法定刑以下判处有期徒刑三年，并依法报请本院核准。本院依法组成合议庭，对本案进行了复核。现已复核终结。
