 【案情】
 原告(上诉人、被上诉人):塞浦路斯斯达迪船务有限公司
 被告(上诉人、被上诉人):中海发展股份有限公司
 1993年11月8日,原告塞浦路斯斯达迪船务有限公司所属“吉米尼”轮于16:00时许从长江口进口,20:00时许驶至吴淞口,并顺流驶入黄浦江。在21:OO时许右正横吴淞客运码头时,发现前方军工路江面行驶的被告中海发展股份有限公司所属的出口船“振兴”轮。21:05时,“吉米尼”轮驶至张华浜2—3泊时,发现“振兴”轮左转进入进口航道,随后又大角度右转,“吉米尼”轮即减速至微速前进。21:07时许,“吉米尼”轮驶抵张华浜5泊时,与“振兴”轮会遇驶过。同时,“吉米尼”轮采取了左舵10、左满舵、前进二的措施,因左转不明显,“吉米尼”轮即采取停车、快倒车、抛双锚的措施。21:10时,“吉米尼”轮连续碰撞了停泊于张华浜7泊位的“货0903”驳、“海港19”、“海港6”两拖轮及“黎明”等船舶,并间接碰撞了张华浜7泊位码头。
 “振兴”轮于1993年11月8日19:OO时驶离立新船厂游龙路码头逆流出口试航,19:20时过黄浦江114灯浮,19:32时过黄浦瞭望台,20:04时过西沟信号台,20:38时过高桥信号台。在驶过106灯浮以后,为避让抛锚在航道中央的小船,左转驶入进口航道,让过小船以后,又右转驶向出口航道。21:07时许与“吉米尼”轮会遇驶过。
 事故发生后,原告与上海港张华浜装卸公司协商,赔付其码头损失55万美元;与“黎明”轮船东协商,赔付“黎明”轮损失8 041美元。就“货0903”驳及“海港6”、“海港19”两拖轮的损失,重庆长江轮船公司及上海港复兴船务公司已分别提起诉讼,请求本案原告赔偿。
 原告塞浦路斯斯达迪船务有限公司诉称:此次事故是由于“振兴”轮穿越进口航道所致,被告应承担全部责任,请求法院判令被告赔偿“吉米尼”轮损失及已支付的张华浜码头和“黎明”轮的费用、重庆长江轮船公司和上海港复兴船务公司要求其赔偿的费用共计931 394.50美元和2 698 704.42人民币。
