When a student does internship in an enterprise based on the arrangements of his or her school, the internship is an extension of the teaching activities of the school, and both the school and the enterprise have some safety education and management obligations. As the student does internship for the purpose of engaging in practical operations related to the knowledge he or she has been taught at school, it shall not be determined that there is a labor relation between the student and the enterprise. The dispute over compensation for an injury suffered by the student during internship shall be treated as a general dispute over civil tort. According to the relevant legal provisions on tort, the student, the school, and the enterprise shall undertake corresponding civil liability according to their respective extents of fault. 学生基于学校的安排到校外企业实习是学校教学内容的延伸和扩展,学校和企业都负有一定的安全教育和管理义务。学生在校外企业实习期间进行与其所学知识内容相关的实际操作,不应认定学生与企业之间存在劳动关系。学生在实习过程中受到的伤害,应按一般民事侵权纠纷处理,根据有关侵权的法律规定,由学生、学校、企业按过错程度承担相应的责任。

 被告:江苏强维橡塑科技有限公司。
 被告:徐州工业职业技术学院。
 原告王俊因与被告江苏强维橡塑科技有限公司(以下简称强维科技)、徐州工业职业技术学院(以下简称职业学院)发生人身损害赔偿纠纷,向江苏省宿迁市宿豫区人民法院提起诉讼。
 
 原告王俊诉称:原告系被告职业学院工程系橡胶大专071班的学生。2009年12月1日,原告进入被告强维科技顶岗实习。 2009年12月30日下午3时许,原告在给被告公司新厂房门刷漆时受伤,后被告强维科技把原告送往宿迁市中医院救治,又转至句容市中医院救治,住院治疗23天。原告在被告职业学院的安排下在强维科技实习,在强维科技工作时受伤,两被告应共同赔偿原告的伤后经济损失。现要求判令两被告赔付原告各项损失134 904元,并负担本案全部诉讼费用。
 被告强维科技辩称:原告王俊因自己的过失受到伤害,其应承担大部分责任。我公司与原告之间没有劳动或雇佣的法律关系,我公司是受职业学院委托进行原告的实习工作,该实习行为是职业学院教学的延伸,其实习应派驻老师,且一般性工作和持续性工作应由职业学院指导,我方不应对原告承担赔付责任。原告受伤是在2009年12月30日,原告起诉已过诉讼时效,对其受伤原告已无法查实。
 被告职业学院辩称:原告王俊在2009年12月底在被告强维科技处受伤是事实,我方就赔付事宜多次与强维科技进行协商。原告在事故发生时的身份已经转变,是作为员工在公司工作的,从伤害过程来看,学校是没有过错的,所以不应承担责任。学校和强维科技不是委托、被委托的关系,是原告经过双向选择进入强维科技工作的。综上,我方不是适格被告,不应承担赔偿责任。
 宿迁市宿豫区人民法院一审审理查明:
 原告王俊系被告职业学院工程系橡胶大专071班的学生。2009年12月1日,被告职业学院按教育部文件统一安排毕业生实习,原告进入被告强维科技顶岗实习,约定第一个月工资1000元,从第二个月开始每月工资1500元。2009年12月30日下午3时许,原告等人在强维科技安排下,给其公司新厂房门刷漆,因厂房门比较高,原告站在三角架上刷门,在推动三角架从一侧向另一侧时不料三角架倾倒,导致站在三角架上的原告从2米多高的三角架上坠落受伤。原告受伤后,被告强维科技把原告送往宿迁市中医院救治,后转至句容市中医院救治,住院治疗23天,原告因就医治疗支出的医疗费、误工费、护理费、伙食费、营养费、交通费等合计43 305元。被告强维科技已给付15 000元医疗费,并护理11天。诉讼中,经法院委托鉴定,原告伤情构成十级伤残。根据本地城镇居民人均可支配收入计,原告的残疾赔偿金应为45 888元。
